Hi All, I've looked but not found this case and I'm new to this. We plan on getting married in Ecuador with a civil union and would like to be able to come back to the States together post honeymoon. Is this possible? We just want to know the best avenue to proceed. We can afford to go either route and have proper documentation for either other than a wedding license obviously. Please give us your take on the situation. Anything can help! :):)

If you get married - the only two avenues remaining are the K-3 and CR-1 (K-1 is for unmarried couples). CR-1 is probably the best choice (remaining) since it will end up costing less $$ and once in the US, you won't need to spend time and money waiting to adjust status to a permanent resident (PR/Green Card). CR-1 might take just a bit longer (than a K-3), but for many it is worth it. :thumbs:

No, it's not possible to return to the US together. Karen and Otto are right--you must apply for a spousal visa and wait it out.

2008-10-14.....Interview--221g, asked to present joint sponsor inspite of NVC approval

2008-11-07.....Visa due to arrive. DHL truck delivering visa was robbed, Consulate required us to present I-864s and DS-230 again, had to get a new passport and other related documents

2008-11-14.....Presented all new documents in person at Consulate, visa printed same day

2008-11-25.....POE Atlanta

2008-12-26.....Green Card and 2nd Welcome Letter arrive

2010-09-02.....Date of NOA ROC 1-751

2010-12-13.....Approval of ROC

2011-01-12.....10 year Permanent Resident card arrived

2011-12-20.....N-400 Application mailed

2011-12-29.....NOA

2012-02-02.....Walk-in biometrics (appt was for 2/16)

2012-04-17.....Interview

2012-05-18.....Naturalization Ceremony

No, it's not possible to return to the US together. Karen and Otto are right--you must apply for a spousal visa and wait it out.

Correct me if I got bum information, but I was told that Jenny could get a tourist visa, prior to marriage, get married , we'd file a 130 go the CR/1 route and it would still be ok for her to return with me. Understanding that she'd have to return to Ecuador before the Cr/1 interview while still on a tourist visa and would have to prove she was going to return on the tourist. The 9 - 12 months would give us time to plan a church wedding. Is this scenario possible? Probable? Thanks! :) :)

Yes that is technically correct. What are the chances of her getting a tourist visa? What you also must know is that even with the tourist visa, she is not guarenteed entry into the U.S. She may also be given a limited stay when she enters with you.
