Hi,

I currently live in the UK and my fiance lives in the US..

We were wondering if a better way to go about the whole moving together thing would be just to go there on a visa waiver.. and get married and simply stay..

Does anyone know of anyone who has done this... or do you suggest myself applying for the fiance visa?

Entering the U.S. as a visitor with intent to stay and adjust status (if that is what you mean by 'simply stay') has a fancy word. It's called visa fraud.

Although I am SURE people have done it and been fine, I am also sure that people have gotten caught, deported, and banned from the U.S. for misrepresentation. You have to ask yourself if a lifetime ban from the U.S. is worth the risk.

The fiancee visa is for people exactly like you. Good luck and welcome to the journey.

during the processing time, would either of us be able to visit eachother?..

No silly questions. This process is difficult and complicated. VJ members are great at answering questions.

Yes, you can visit. the USC is of course able to visit the UK. And technically the beneficiary can go to the U.S. although it may be more difficult once you file the K-1. But as long as you tell the truth and do not overstay, you should be Ok.

Have you thought of getting married and filing for the CR-1? It allows the spouse to enter the U.S. as a resident and also permits immediate travel and work. Something you do not get with the K-1.

Ah right, I never knew about that at all, that is something I should look into... I'm emailing my partner all of the information.. all at once it seems lol.. it's a lot for us both to take in all at once!
