You apply for the EAD and AP at the same time as the AOS because then it's free. Otherwise you'll have to pay separately for the two documents.

AP can be used in cases that isn't an emergency too. It takes roughly 8 weeks. If there is an emergency though, you can make an infopass appointment and expedite it and receive the emergency AP on the day.

I've posted this elsewhere, but my grandfather died yesterday suddenly; I'm looking into getting emergency AP but apparently am not eligible as we haven't yet applied for AOS. I'm trying to get my K1 re-validated by the consulate so that I can go back to the UK and then use it to re-enter, but it doesn't look good.

My condolences, Gemmie. I hope you'll get it all figured out so you can fly to UK and back.

We hear from the lawyer today!!!!! Woot!!!

He was right

Judge handed down a court order stating that USCIS must come to a conclusion with our case within 30days (which would be the 15th of June by my calculations) otherwise they will be in contempt of court and someone gets to head to the big house for a while.

So Chris has for the 3rd time put together our Package again and is fedexing it off to the Lawyer to give to USCIS tomorrow, hopefully they will have it sorted soon, I'm excited that we feel like we are moving, sad that they didn't just hand us the NOA2 though, however I think I can finally honestly say there might be a light at the end of the tunnel.

Our Lawyer plans to help push it through NVC and the Sydney Embassy too, so hopefully November will be home time for good, well shall see. On the positive it means on this trip we can prepare packet 3 and I can bring all that stuff home with me.

Terrific news, Mara. Keep us all updated, I'm betting they won't even take the full 30 days to bring you your NOA2. I'm glad they've gotten a smacked wrist for their neglect.

Thanks for the condolences. Turns out my grandfather had cancer and had kept it a secret from us.

Trying to arrange the funeral and cancel accounts etc from the US. Our congressman claims he knows no way to revalidate my K1 and keeps repeating that we need to get AP, which we keep telling him we can't get. I think it's clear that I'm not leaving any time soon. This has set back some plans for our ceremony.

Gemmie: You are strong, I know your grandpa didn't say cause didn't want you to regret anything, so keep on going with your plans, my hubby's grandma also had cancer, we all knew, and in spite of that he came to USA, she died the week after we got married, they lived together so it was really shocking, but he knew it was a decision he had to take cause we were separated for so long that he thought it was the best thing to do. May they rest in peace.

Good news. We had out inteveiw this morning and all went well.

A full year wait and we pick it up in 5 days.

WHEW! Now for the AOS stuff and SS card and the stateside headache! UGH!

I just need a job now! Lucky everything happened after financials were sent in!

Congrats on the interview, the state side stuff is hardly a headache, it's pretty easy, even if you have to travel a few hours one way to get to the local USCIS offices.

Thanks for your kind words, Cuchita. I'm sorry for you and your hubby's loss too. I'm sure his grandma wanted him to be happy.

We decided that I'm going to celebrate his life from the US by making a memory book (photos, stories, drawings) and sending a letter in a bottle over the ocean (his ashes are going in the ocean). I miss him so much and have so many regrets, but I know he wouldn't want me to feel that way. He always asked me if I was happy out here, and even when I was going through some adjustments, I told him I was. I'm glad he took that with him. The last thing I said to him was "God bless, love you" which I never meant more true.

Congratulations Hyena, it's been a long time for you. Now we just need you and Mara to make it here to your August family.
