Lost in Translation

Greetings to all my long suffering friends,

I am almost ready to submit my I-130 for my wife, However "Big Brother" requires a translation of my marriage cert. Can I use a generic translation form or do I need to duplicate it in English ? Am I correct in assuming that I can perform the translation myself as I am fluent in Spanish ? I can't wait to join you folks in the long and painful process of dealing with the highly efficient and concientous U.S. Government.

It doesn't matter if you speak spanish. If you need translations they have to be done by a certified translator.

What stinger said isn't true. You can translate it yourself; I did for my husband's birth certificate. You just need to sign an additional sheet of paper that has wording about it being an accurate complete translation. The wording is on the state.gov webiste somewhere. I'll see if I can find it and post the link here.

what I said is true. If he needs translations....

If the process is still in the early stages no translations are necessary. The consulate accepts documents in the language spoken in the country and in english.

I realize the Mexican consulate accepts documents in Spanish - having been through there myself.

As far as AOS goes in the US , my husband's AOS was approved with my husband's birth certificate translated by me with the accompanying sheet saying it was an accurate complete translation.

Translations. Any foreign language document must be accompanied by a full English translation that the translator has certified as complete and correct, and by the translator's certification that he or she is competent to translate the foreign language into English.

You have to certify that you are COMPETENT to translate it, but you do not need to be a certified translator.

I also wanted to add that our immigration lawyer did make us have certified translations to submit with our initial filing of I-130 and I-129F and I believe she was correct in doing this, since the petitions are originally submitted and approved by US Service Centers prior to being sent to the consulate.

They ask for certify and notarize translation of all documents. I had to do both however I.

l spoke to someone who only had the documents translated by a person that stating to be fluent in both languishes. I think is better to have them certify and notarize, I weren’t take a chance

The consulate however is not what the OP asked about when you replied 'It doesn't matter if you speak spanish. If you need translations they have to be done by a certified translator.' That was incorrect as USCIS in general with the filing of initial petitions, only requires that one be coversant in both english and the foreign language and certify as such as well as that the translation is complete and accurate.

Where is it that USCIS asks that all translated documents have to certified and notorized?

Hi;

My suggestion is to have it translated and notarized by some professional. Thats what USCIS expects and its also a good idea just to be on the safe side. You dont wanna send the application and then worry about getting an RFE. My suggestion: be as perfect as you can be. Good Luck.
