my parents are applying tourist visa to come to america to vist me.

i am in the middle of N400 right now( waiting for citizenship interview.

if my parents can get the US visa, when my parents come to ameirca,

should they apply their green card in the US or they should just wait until

they go back to china to apply over there?Which way is easier? and less time?

How long can do they have to wait?

I-130 For My Parents

08/10/09 - I-130 Sent to Chicago

08/19/09 - checks cashed ( $355 each )

08/21/09 - I-130 NOA1 Received

09/28/09 - Touched

10/06/09 - Received RFE

10/07/09 - Send RFE request doc.

10/14/09 - Touched (RFE request doc. received by USCIS on oct.13th)

10/27/09 - Approved (approval emails received)

11/05/09 - Rec. both NOA2 in mail. called NVC get case # for mom's case and emails regd.

11/06/09 - called NVC get case # for dad's case and emails regd.

11/09/09 - Received my mom's DS3032 & ASO bill via email

11/10/09 - Paid ASO bill $70

11/12/09 - Received my dad's DS3032 & returned Completed DS3032 forms (By email)

11/12/09 - Send Completed paper DS3032 forms (From China)

11/16/09 - Received IV Bills (By email)

11/18/09 - Paid IV Bills ($400 each)

11/24/09 - I864 mailed via Priority mail

11/30/09 - I864 delivered to NVC

01/14/10 - DS230 mailed via Priority mail

01/19/10 - DS230 delivered to NVC

02/02/10 - Login failed

02/09/10 - forwarded to GUZ

04/26/10 - received interview letter scheduled for 06/17/10 in Guangzhou

You have 2 options, file an I-130 AFTER your become a citizen, OR if they are in the country visiting after your become a citizen, you can file an I-130 and I-485 to adjust status.

I-130 for an IR-5 immigrant visa can take longer that a year through Guangzhou consulate.

Adjusting status can take 4 months of longer, if you apply for EAD, they can legally work in the USA when they get EAD.

IR-5 is an Immediate Relative visa, parents of a US citizen get an IR-5 visa.

Immediate Relative and Family Based Visas:

  • IR-1/CR-1 Visa (spouse of a U. S. Citizen)
  • IR-2 Visa (Child of a U. S. citizen)
  • IR-3 Visa (Adopted Child of a U. S. Citizen)
  • IR-4 Visa (Child to be Adopted by a U. S. Citizen)
  • IR-5 Visa (Parent of a U. S. Citizen)
  • F-1 Visa (unmarried son or daughter of a U. S. Citizen)
  • F-21 Visas (spouse of a legal permanent resident)
  • F-24 Visas (unmarried son or daughter of a legal permanent resident)
  • F-3 Visas (married son or daughter of a U. S. Citizen)
  • F-4 Visas (brother or sister of a U. S. Citizen)

In either case an I-130 is filed to start a visa process for an immigrant visa, and if the prospective immigrant is in the USA as a NON-Immigrant visitor, they then file an I-485 at adjust status. The I-485 needs a basis to adjust from, that is the I-130, a NON immigrant cannot adjust status directly from a visitor's visa.

If you study the I-485 instructions to adjust status an it needs to be filed concurrently with the I-130, it is based on an I-130 when approved would result in an IR-Visa, the I-485 has "A" Checked .

You would use one of these 2 guides, with some adjustments for a visa for parent.

Yep, this is one I have seen many times.

If a parent of a US citizen enters as a visitor, stays a few months and then decides they wish to immigrate, they can file an I-130 and I-485 to adjust status.

What's gonna happen if parents's visa were expired while they are waiting the the adjust status in the US. do they have to go back to their country?

Yep, this is one I have seen many times.

If a parent of a US citizen enters as a visitor, stays a few months and then decides they wish to immigrate, they can file an I-130 and I-485 to adjust status.

Just like a K-1 adjusting status, they will be AOS pending and can remain in the USA until USCIS makes a decision on the I-485.

If they file I-765 along with the I-485, they can work using EAD card.
