This is the second time they are telling me this.If I have to go there again,I want them to pay for my plane ticket ! :angry:

May 7,2007-USCIS received I-129f
July 24,2007-NOA1 was received
April 21,2008-K-1 visa denied.
June 3,2008-waiver filed at US Consalate in Panama
The interview went well,they told him it will take another 6 months for them to adjudicate the waiver
March 3,2009-US Consulate claims they have no record of our December visit,nor Manuel's interview
March 27,2009-Manuel returned to the consulate for another interrogation(because they forgot about December's interview),and they were really rude !
April 3,2009-US Counsalate asks for more court documents that no longer exist !
June 1,2009-Manuel and I go back to the US consalate AGAIN to give them a letter from the court in Colon along with documents I already gave them last year.I was surprised to see they had two thick files for his case !


June 15,2010-They called Manuel in to take his fingerprints again,still no decision on his case!
June 22,2010-WAIVER APPROVED at 5:00pm
July 19,2010-VISA IN MANUELITO'S HAND at 3:15pm!
July 25,2010-Manuelito arrives at 9:35pm at Logan Intn'l Airport,Boston,MA
August 5,2010-FINALLY MARRIED!!!!!!!!!!!!
August 23,2010-Filed for AOS at the International Institute of RI $1400!
December 23,2010-Work authorization received.
January 12,2011-RFE

This sounds like either very poor recordkeeping or game-playing on the consulate's part. Get your U.S.-level elected officials involved pronto, si man.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

sorry to hear about this. (F) i just read your timeline. it's crazy! might i ask on what terms the visa was denied?

He did something wrong and now requires a waiver. If your fiance has broken no laws, you will not have this problem.

OP - I don't think the visit matters - they don't doubt your relationship. Aren't you waiting for the waiver to get approved?

Seriously doubt it's "game playing".

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

It could actually be 'game playing' this is the same consulate that tried to tell her fiancees weren't eligible for waivers. . . they're not exactly "up" on the law or apparently procedures or record-keeping.

I say work with Senate/House reps. . .if they really don't have records then something is wrong. . . but probably they're just giving you faulty information.

Yes,I have.And they always tell me that they are going to send a letter but since I had not seen any movement,I decided to start checking myself.

I am so sorry you are getting the run around and applaud your efforts to do things on your own, but at the same time I'd be getting on your reps repeatedly to get them to do some work as well!!!

This sucks. Get on the horn to your reps and senators. Time to start making lots of noise. That's what I ended up doing when I got fed up with the incompetance at DOS and DHS. Hang in there, don't let them beat you.

Thanks.I'm afraid they're just stalling until April 21st so they can turn around and say the case is cancelled. :unsure: I refuse to give up !

I am so sorry .(: I know the feeling. The best you can do is NEVER GIVE UP. I know it is frustrating that you can't prove at times that you are right, but you have to buil up the faith in you that soon it will be over.

Don't give up, try all the possible ways that might help you. If you can , visit your the conslate and try to talk with consul general, try to get direct answers, try to know what they want. Hopefully sooneverything will be over.
