Hello :)

I expect to receive the RFE for my I-129F soon. The first idea I had was that it would be the new I-129F form and that all. Is this right? If it is, then I will have to mail it to my wife and have her sign her name in her native alphabet...wait for her to send it back....then send it in. That kinda stinks.

Can anyone tell me if this is right or wrong please. If the RFE is the new I-129F, then I'll go ahead and fill it out and send it away so I'll have it back when I receive my RFE.

I am not totally sure we K3s are going to receive RFEs. I was on the phone with USCIS this morning about a different issue and when I asked them about this subject, they said that we will not be getting one. Of course, this could be wrong information (from the "Mis-information Line!") but I would wait and see what happens.

From what people here have said, if they do send an RFE, it will be a proper RFE and not just be the new I-129F form. You should probably wait until USCIS specifically requests something from you, but that's just my opinion based on what I've heard.

I-130F:

13 Feb. 2006 - sent I-130; 14 Feb. 2006 - I-130 received at Nebraska

28 Feb. 2006 - NOA-1

2 Mar. 2006 - RFE for payment problem; 3 Mar. - corrected & mailed; 6 Mar. - USCIS rec'd payment

12 June 2006 - APPROVED! (NOA-2)

20 June 2006 - case number assigned

3 July 2006 - DS-3032 and AOS Fee bill generated; 6 July - emailed DS-3032 Choice of Agent

13 July 2006 - Received DS-3032 (UK)

14 July 2006 - DS-3032 mailed to NVC

17 July 2006 - DS-3032 and AOS Fee received in mail

19 July 2006 - mailed Fee bill to NVC; recieved at NVC St. Louis facility 20 July

27 July 2006 - APPROVED!

04 Sep 2006 - Medical completed.

Do not send anything to USCIS before you get any RFE from them.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

When a call is placed to the USCIS 1-800 Customer Service Center the person answering the phone is a contractor and can be very new to the job. That is the nature of government contracting, here one day, gone the next. There are 2 levels of support and any call may be answered by level 1 or level 2. I have asked the same question and received 3 different answers on filling out an I-130. I do not think USCIS Customer Service has any idea yet how they will deal with I-129F petitions but I would not send them anything unless they ask for it.

The fiancee (beneficiary) never signed the I-129F to begin with. This form is signed by the petitioner only. Your fiancee had to sign the biographical form and this isn't being sent back as part of the RFE. As posted, the RFE will be a simple document with questions asked that you (the petitioner) will sign and send back. :)
