My spouse in the US sent request for his divorce certificate from the State of Utah and they replied with that they have no record of it. He said he used to have a copy and remembers signing it. He remarried and divorced after his first marriage and now we are married. (I know, not a good track record, but we are making this one last forever.) So does anyone have any suggestions of what we might do?

Should he file for divorce again even though he knows he was legally divorced before? And if that was the case, then is his second marriage void? What about our current marriage?

I love being a Canadian.

If there is no Final divorce decree on file, most likely the divorce was not final, so not divorced. and that makes your marriage invalid/void. I would have him call the county of where the divorce was filed, give them the cause number, and they will be able to see if a final decree was ever signed by a judge. Good luck.

As long as he has divorce papers from his 2nd marriage, that marriage is legally disolved. So that one is fine.

If there is no Final divorce decree on file, he will have to file for divorce from her, once it is final, you and him will have to re-marry, then re-file with USCIS. Good Luck, I hope it works out for you.

IN DIVORCE, BOTH PERSON WILL HAVE COPIES OF THEIR DIVORCE DECREE. TELL HIM TO NICELY ASK HIS EX IF HE CAN LET HIM BORROW OR HAVE CERTIFIED COPY OF THE DIVORCE DECREE. IF HE REMEMBER THE COURT APPROVED THE DIVORCE HE CAN ALSO CALL THAT PERSON BECAUSE THEY HAVE TO TRACK THEIR RECORD TOO. GOODLUCK... !
