I want to know if the petitioner is the only one who can cancel a visa application. I have a friend who wants to cancel his application. He had a K-1 application filed for him but him and the woman did not work out he contacted the EMBASSY to cancel the application and was told that only the petitioner can cancel the application. What can the beneficiary do to cancel the application? He wants to apply for a vistor visa but it will get denied if there is a open visa application in his name.

Packet 3 Received: Sept. 3, 2008

Interview Date : Dec. 18, 2008

APPROVED!!!!

Dec. 19, 2008- Alfredo comes home!

Jan. 5, 2009: Alfredo and I become husband and Wife

March 10, 2009 AOS paperwork sent, will wait for it to arrive via tracking #

March 12, 2009 AOS paperwork arrives in Chicago

March 23, 2009 NOA1 for I-485, I-131, I-765

March 30, 2009-Biometrics letter received, appt date April 10th @11am philly office

April 10, 2009-Biometrics appt. done, in and out in 15 minutes

Nov. 18, 2009-Card production ordered

I would think the petition would be null and void being that old.

If your friend hasn't heard from the embassy (package of paperwork would of been needed to be done) - I'm pretty sure that it's dead.

He can apply for the visitors visa, and if this K-1 comes up - he will just have to explain what went on.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I just canceled a K1 application. Since I had recently mailed the I-129 F, USCIS instructed me to just write a letter, which I had notarized, and mail it to them stating that I wanted to withdraw my petition. Now, if your petition had made its way to the embassy, I'd just send a notarized letter asking to withdraw it and then I'd follow up with another letter to USCIS confirming that you wanted to withdraw it as well. I know the OP said it had been years ago and maybe the petition did expire, but I know I just would not want some immigration file out there with my name on it without a resolution that I knew about.
