can anyone provide any help with our situation we are going for the K1 visa and currently have packet 3.

Our situation:

Beneficiary (UK Citizen)

----------

Currently living/working in the UK

Petitioner (Dual US/UK Citizen)

----------

Born, lived and worked in the UK, quit job in the UK in Jan, moved to states to look for a job so can fill out the affidavit of support (as we were told UK income would not count towards this).

As we are all aware of the economic situation right now, the job hunt isnt going well. We have no option of getting someone else to file a supporting affidavit of support. Does anyone have any suggestions?

How long are we able to hang onto packet 3 before sending the forms back?

Is it possible to put the visa on hold for say 6 months and pick up in this position when we are able to file the affidavit of support?

I have US tax returns for the past 3 years, while i hunt for a job I am doing freelance work, could this count towards the affidavit of support, if so how do i prove this income?

Freelance would be fine, the same way as you would for the IRS.

i have only just started freelance though and only doing it till i find full time employment so dont have much in the terms of paper work for it. also what about the letter from employer? wouldn't any body just be able to say they worked freelance and earned $X per year? Also how do you prove its regular income?

Not everybody has an employer. And there is no need for one. If memory serves me right you need to show the numbers at interview time.

You can hold the packet 3 papers as long as you want. They are meaningless in the timing of the process and you could have downloaded them before you filed the petition, years before, and held them for years. Whatever you do with the papers, the approved petition expires in 4 months. I believe you can get an extension, contact the embassy.

No, this will not count. They go by CURRENT (current means TODAY) income first, followed by assets which they credit at 1/3 toward the poverty guidelines.

I have no other suggextions other than get a job, use assets if possible, or get a co-sponsor.
