Hi,

In May 2008 I got divorced with my ex. So I filed to remove conditions based on Bona fide marriage in July 2008.

I got divorced because in February 2008 my ex had an affair and cheated. My ex filed for divorce, because I've heard if I filed it would be much more difficult to remove conditions....So he filed and we got divorced very quickly after a year of marriage.

As support documents for my petition to remove conditions I attached about 2 pounds of documents: bank accounts, contracts for buying a house and a condo, lease for apartment, tickets from trips abroad together, contracts with vendors for our 2 weddings (yes, we had 2 of them!), health insurance, car insurance, pictures from both weddings, some other documents I cannot think of right now...But it was 2 pounds total - so I collected pretty good evidences...As well as letters from our friends who wrote what a loving couple we were until my ex messed up and what he did...

So my petition went to Vermont. Got my fingerprints and nobody "touched" it since then...As well as my case hasn't been forwarded to Cali...

My question is: Does that mean that I will have an interview since they did not forward my case to Cali? Should I start looking for an immigration lawyer?

First, very sorry to hear. According to what you mentioned, you have good evidence to show that it's bona fide, they may call you for interview but I don't think it's necessary to hire a lawyer just yet, not until you actually get the interview appointment notice because they might not call the interview if the evidences are really good enough for them. Plus, our "Very Slow Center" has just started approving cases that filed on early April and they had pawned out 80,000 cases (filing June to August as of now) to CSC. So if you filed in May, you probably won't hear from them for another month and if they call for interview, it should be at least two weeks from the notice date for you to prepare. Hey who knows? They might just approve you without RFE or interview. So for now, give it more patience, you've waited ten months already, one more month will pass by soon enough. If you still don't get nothing back until May, which is one year from your filing date, you should contact local senator or congressmen to inquire the status about your case. Hope that helps! Don't give up! If you're in Houston TX area, I do have an excellent immigration attorney that I can refer you, that's if it comes down to that point.

Sorry Corolla this happened to you. I think you will be clear with the above evidence. Do hire an immigration certified lawyer for the interview, if your called for one --- the worst case scenario. Your petition has gone to Vermont since its a service center. Most cases get approved from service centers, if not, they come back to your local field office for an interview. --- very rare. Its hard to predict how long long a waiver may take to get processed. Its could be as fast as 2 months or slow as 2 years.

Hello...I am sorry to hear that...and I have to say that the same thing happen to me. he cheated and we got divorce after one year. In my case...I was the one who file for divorce not him. I am about to send my papers on the 17th...got everything together: car loan, bank account, insurance, other documents to both our names...letters from his dad, HIM and other friends who has known us for many years....single and married...so I guess even though I filed , I am covered. We will see...any extra advise you might think of????

Nobody knows if you'll be interviewed or not. If you happen to be interviewed then just prepare yourself for that. I have not seen posted topics of those who got interview notices, maybe it's rare. You have enough evidences to support your case so just relax and wait. The timeframe of regular & us wiver filers are similar. We got rfe's, sometimes not so everything depends on them..Best of luck!

According to what you mentioned, you have good evidence to show that it's bona fide, they may call you for interview but I don't think it's necessary to hire a lawyer just yet, not until you actually get the interview appointment notice because they might not call the interview if the evidences are really good enough for them. Plus, our "Very Slow Center" has just started approving cases that filed on early April and they had pawned out 80,000 cases (filing June to August as of now) to CSC. So if you filed in May, you probably won't hear from them for another month and if they call for interview, it should be at least two weeks from the notice date for you to prepare. Hey who knows? They might just approve you without RFE or interview. So for now, give it more patience, you've waited ten months already, one more month will pass by soon enough. If you still don't get nothing back until May, which is one year from your filing date, you should contact local senator or congressmen to inquire the status about your case. Hope that helps! Ooops! Sorry! I read it wrong!

hmm... may be they did forward you but somehow forgot to update your status online? If that's not the case then as far as I know, they haven't done anything to you yet, so stop worrying and wait patiently, deal with it step by step when it comes. If by July, one year from your filing date, still no result, then get senator or congressman involved to make an inquiry on your case.

If they (USCIS) don't see enough evidences they call for the interview in order to see

if the marriage has been entered in a good faith at the beginning & completely Bona Fide.

You do not have to hire a lawyer, that is just wasting of your money. I am sure you can

defend yourself. Gather all evidences as many as you can. You had better get some affidavits

of mutual friends of you & your eX.

It usually takes about a year to sort this application out because you checked waiver due to divorce.

Next time please give your Timeline.

I am a little worried because we rescheduled the interwiev for the 1st green card...The way it was that we had tickets and hotel paid to go on vacation to Russia and Egypt together with my parents in July 2007. USCIS scheduled my interview right in the middle of July when we were supposed to be out of the country....So we set up info-pass appointment, showed them tickets and asked them to reschedule the interview....I had it in October 2007 instead...

Now I think maybe they will find it suspicious that we rescheduled the first interview...And Actulally before that we moved from California to Georgia - after I changed the address with USCIS they cancelled my interview in May in Cali - funny thing I did not even know about this interview...They scheduled it the next day after I moved out of Cali so I never got the notice about the interview...

So 2 rescheduling and a divorce...I'm freaking out now...I guess I'll wait and if I get interview I'll hire the lawyer...

From what I've seen people that file divorced end up being interviewed. Don't really know if that holds true in all cases.

Can't see how a lawyer would help much as long as you have lots of evidence YOU married in good faith and not just for immigration purposes.
