Hi, I need help

I am a newbie and am not sure if I am doing everything correctly. Me and my husband received a approval for an I-130. The letter said that I file was sent to NVC for processing of a visa. I AM CONFUSED....bc my husband is here in the US and does not need a visa. Why did they send our paperwork there???? I am oblivious to this process....we have a lawyer and he does not make sense to me. Since, he is already here in the country why do we need a visa.

I am not a lawyer but I would think u probably were supposed to file both I 130 and I 485 (adjustement of status or AOS for your spouse) after u got married. I believe you should still be able to file for AOS. Ask ur lawyer abt it and also call USCIS and ask them what u should do. Please don't go by what I said, I am by no means an immigration expert and do not know the specifics of ur case. You can of course also call NVC and see what they would recommend that you do.

You may also want to post this question on the main forums and hopefully u will get many people's input. But rmb u should always go with what an expert advises u such as an immigration officer at USCIS or ur lawyer. I am surprised to hear ur lawyer is of no help. What did he tell u exactly? He should be able to research this for you. Good Luck!

Shout out to Queue

On the NVC forum some one made a comment that they sent the DS3032 as soon as they got the case number....they did not wait to receive notification that choice of agent was generated.

what are you thoughts on this?? btw how long did it take NVc to generate DS3032 and AOS in your case?

You can email in the DS-3032 and wait for a response, they usually take a 2-4 days to review and respond. If they review your email before the DS-3032 they will just send you back a response to wait for the ds-3032 to be generated.

It took three business days for NVC to generate my AOS Bill and DS-3032.

You can email them today, and see what happens

I would call uscis ask them what happend

Aruba - for your paperwork, they won't start reviewing it until the visa fee issue is resolved. So start counting from there.

Esposadetucho - That means your cases are still not in the NVC system. Has a operator been able to tell you that the cases are in the system? Also are you checking for both your I-130 and I-129F?

I am checking both and I already talked with USCIS. They have no information. I even called twice to make sure I go the same answer.

Q, question for u guru: Did u get ur inteview date the scd week of march prior to NVC giving u the OK for case complete or did u have to wait till they were done reviewing the case first and then told u the date. How did they notify u of the interview date and of case completion? Did they email you at both stages?

The case has to be completed by the end of the first week of the month to be part of the cases scheduled for interviews the following month. I checked with NVC the status of my case until the case was complete. I then called them the Monday of the second week, and was told that my case had been scheduled for an interview, operator gave me the date and time. The next day I received an email from NVC with the interview letter attached.

So they didn't/don't email when case is completed? You had to call to find out?

Does this mean completed as in u send in all required docs/ all payments made & received by NVC or completed as in reviewed & completed by NVC (i.e NVC REVIEW OVER)?

ok that is march 12th so that is a week thursday

Jenn - Did you call USCIS and double checked if they really sent it to NVC not to NRC?

Georgina - I think your case would be completed soon.. I just spoke with an operator and gave me that 2-4 weeks review #######..

yep, just got off the phone with them. nobody knows anything

NVC says they don't have any record, USCIS says they have no iformation. Senators office and Congressional offices say it was sent March 6th. Its in limbo land. This is so frustrating
