My mother and stepfather are our joint sponsors, we were going over their forms tonight. My stepfather claims his two children as dependents still therefore gets earned income credit for them. Will we be able to use that as 'income'?? Without it they may not meet our income requirements! help!

I have no idea, but I'll take a stab. I think 'income' for the I-864 means his income he receives from an employer. What is the 'earned income credit'? It sounds like a tax break. Is that true?

When you have a child in the US and you claim them as a dependent on your taxes they give you money thats all i understand of it lol. This is why i'm not sure if its usable

I would be incredibly surprised if it is admissable as 'income'. They want your gross income, before tax - so also before credits I should think.

I say play it safe, list what he has on his W-2 and keep it at that. Isn't that 'earned income credit' supposed to be allotted to the children? Not you and your husband?

well they're not my kids so i dont think i'm getting any money

We ordered tax transcripts for them so i'm not sure if its listed on them anywhere, i'll see when they come in the mail. I'm just really hoping its ok!
