I'm not a psychiatrist, but that doctor is. It's why we have expert testimony in cases like these. Otherwise, you could start your own legal consulting firm. Call it, "Just ask Charles."

He HAS to be insane! no sane human being could do this. I just hope they detain him forever. How very sad.

A Canadian judge ruled Thursday that a man accused of beheading and cannibalizing a fellow Greyhound bus passenger is not criminally responsible due to mental illness.

"He did not appreciate the actions he committed were morally wrong. He believed he was acting in self-defense," Scurfield said.

Both the prosecution and the defense argued Li can't be held responsible because Li was suffering from schizophrenia and believed God wanted him to kill McLean because the young man was a force of evil.

That Li killed the 22-year-old carnival worker was never in question at the trial. Li has admitted he killed McLean but pleaded not guilty.

Li ... apologized and pleaded with police to kill him.

Police said McLean's body parts were found throughout the bus in plastic bags, and the victim's ear, nose and tongue were found in Li's pocket.

A psychiatrist called by the prosecution Wednesday testified that Li cut up McLean's body because he believed that he would come back to life and take revenge.

[The judge] said people who are mentally ill should not be convicted when they don't know what they did was wrong.

"They need to be treated," she said. "I certainly agree in Mr. Li's case he needs to be treated for a very long time."

Doesn't an apology generally mean the person apologizing realized they did something wrong? The "logic" behind that judge's decision falls apart when you look at Li's behavior following the murder. Even if he thought the young victim was evil incarnate, on some level he still realized that the actions he took were deserving of an apology and a plea for death.

I understand this man is mentally ill and I don't doubt that one bit. But he should be charged as criminally mentally ill or something, which should involve treatment at a mental facility with high security and absolutely should not allow for his release back into the community, especially if he gets that opportunity once a year after a screening.

To be found criminally insane, you have to be found to be without mens rea at the time the crime was committed. It doesn't matter if you're aware that it was wrong afterward, the only thing that matters is what you were or were not aware of while committing the crime.

This act was so inhuman and strange in its very nature that I highly doubt it could be committed by anyone of sound mind.

To be found criminally insane, you have to be found to be without mens rea at the time the crime was committed. It doesn't matter if you're aware that it was wrong afterward, the only thing that matters is what you were or were not aware of while committing the crime.

there are special prisons for GBMI .....guilty but mentally insane or ill ..depending on the state ...

years ago, i was offer the director job at ft. larned in kansas....but did not want my nuts kicked everyday...
