Hello

I am US Citizen , i filed I-130 for my Husband in 02/02/2008 , we got married in 2004 and now we have a baby boy 7 months old (US Born) . I dont have a much income becuase of delivery of my baby , i m taking my mother as co-sponser , adding her income is not sufficient as we are 4 members ( Applicant + Immidiate Relative + My mother +our Baby) ,

i try to find more co-sponser but i got answer that we have already sponsered to someone , so we cannot sponser , is it true ?

I have some questions

1. as we need income as shown for 4 members (as shown Above) = $ 26000 but our toatl income is $ 21000 , ?

2. i and my mother have approximately $2000-25000 in our account . is this amount help us?.

3. my father was expired one month back in US , The combined income of my mother and my father was $35000 ( as they filed there tax return combined) , Should i need to attach combined tax return of both or saperate of my mother's ?

Please help me .................................

Hey Pal,

I am sorry to read about your father. In terms of income. I am not at all an expert, but I read somewhere on the forum that you can use your saving accounts (as asset) and it would count as 1/3 of total asset towards your total income. So, if you've $15,000 in your saving account, then that means it can count as $5,000 towards your total. I could be interpreting this wrong, not 100% sure.

Is your mother living in the same household as you?? If so have her file an I-864A, with this she can ADD her income and assets to yours to get you above 125% povertyline.

If you use mother as a Joint sponsor (She uses I-864) she will need to have enough income and assets to support ONLY her, and your spouse, YOU and Your Child will NOT be counted on her I-864.

So you should get a co-sponsor to play it safe.

If you meet the minimum, then you will not need assets to cover your income.

If you are lacking in the income level (125%) you can use assets to make up the difference.

To be counted, the cash value of assets must equal five times the difference between the sponsor's income and 125 percent of the poverty line for the household size.

So the OP has between 2,000-2,500 (I am thinking she meant this value, not 25000) - not enough to cover the difference.

The difference between what she needs to satisfy the requirement is 6562. 27,562 is what the 2009 req is now - what their total income is 21,000.

So, she would need 32,810 in savings to cover the difference (difference X 5) to meet the requirement.

Where do you see the "SCAM" in this? this is straight from the government website.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

yes.... it may work with cash assets.

but I was told that with out any inccome they can still reject you and ask for a co-sponser even if you meet the minimum.

the minimum for me would be 75 grand in my bank.

I guess the only way to find out is to try.

BUT..... now my free lawyer says I should go the K-1 route and get here here first in the USA then file for the I-864
