A couple questions.

1. Is the "A#" that is requested on just about every form the handwritten number on the back of the I-94? Unfortunately, the officer's handwriting is hard to read, but he did write "A" and a number. Is this the only place this number appears?

2. When filing I-131 for Advance Parole, it says that this is an extraordinary measure. I'm working abroad a lot and would like my K1 spouse to travel with me, is that a sufficient reason? What kinds of things have been accepted in regard to this?

3. Is there any way to update my wife's passport with a new visa expiration date now that we are married? Her K visa expires on March 17. Does she (or can she) get something between March 17 and the time the green card is received? If so, how? (For example, she would need a valid visa in her passport to get a driver's license, but is not yet ready to take the exam.)

Timeline

1. The most reliable place to find the A number is on your NOA2. Its a 9 digit number preceded by an A. It may be on your I94, and it may be on your visa, but it's always on the NOA2.

2.I131 is used for lots of different classes and types of immigrants. For some it can only be used in emergencies. For K1, however, it can be used for anything from honeymoon to trips home to whatever.

3. The visa can not be updated. Until she has her GC, some people recommend carrying her marriage license and NOA1 from the AOS with her. But I never did.

Timeline

Regarding driving license. Most DMVs will not issue her a license at this point in the process, as 'officially' she is out-of-status. Some will give her one with an NOA1 from AOS, many will give her one with an EAD card, and all should give her one when GC arrives. It's state and luck dependent.

It will be state dependent. I assume you mean her I-94 expires on 3/17; her visa expired when she entered the USA (although a DMV employee might look at it with its 6 month validity and not know it is no longer valid. So would depend on whether they look at the visa or I-94). I suggest you either visit the local DMV or check their website for what is accepted.

"If I am a non-immigrant with legal presence and renew my Class E license after October 1, 2008, how long will the license be valid and what is the cost?

Driver licenses and identification cards for non-immigrant customers with legal presence will be issued in accordance with the amount of time approved by BCIS, not to exceed one year. Non-immigrant customers are required to submit a Social Security card, if a card has been issued. The cost is $20 to renew a Class E license or $67.00 for a CDL renewal. The word “TEMPORARY” will appear in the front, right lower margin of the license."

Since she has legal status from USCIS, I would take proof of that (Visa, I-94, marriage certificate, and AOS pending proof once received) along with info from USCIS website showing that a K1 is legally present if they married in 90 days and have filed for AOS.

After that, it is as Slightly Bonkers said "luck dependent"

I love the "Slightly Bonkers" bit, John. It is the best explanation I've heard. They told my kids they had to get married again! The State Dept. and USCIS consider them married, but at least one guy in CO doesn't.

Just read the regs for your state and take everything you have with you. The worst they can do is tell you 'no'.
