How long can we wait to file AOS?

My fiance has his interview 4/13 at 8am, and I hope he can come back with me on 4/19. We are just going to the courthouse so will probably get married sometime that following week.

Here's my concern, I only get paid monthly and it will probably be until the end of May or mid-June (we get paid early in June, public school system) before we will have the $1010 to file. We don't want him to be out of status at all, but I'm a little confused on the dates and all, if someone can explain it to me. Here's what I know:

Visa will be (hopefully!) issued 4/14, day after the interview, valid for 6 months to enter (K-1 will expire 10/14, but technically expires at POE, right?)

Upon entry, will receive I-94, valid for 90 days (will expire 7/19 if he can come 4/19)

Do we have to file during this time or does the marriage then invalidate the I-94 and we have to do it immediately thereafter? I'm so confused with some of these official documents, dates, etc. We just want to know if we wait to file AOS until mid-June will we be ok? Thanks in advance for your answers!

marriage has no effect on the I-94. best answer is to file before the I-94 expires. in the end, it is better to file sooner than later, but later is better than never.

You can always wait to travel on the K-1 till June, then you will have the money, and AOS as soon as want. (and that will give you 3 more months to save more money)

(yes - the K-1 is a one-shot entry visa)

But he comes now, 4/19 - and you do the AOS in june 09, you will be ok!

WOW! you got the interview fast! i'm so happy for you...my paperwork left nvc on the 26th...now just waiting for dima to get packet 3.

Thanks! One thing is that Guatemala does not issue a packet 3, so we got packet 4 and the interview date at the same time. Email the consulate if you can - it helped us!
