Okay, here's the problem. My fiance was born on August 6th but when his grandfather filled out his 10th certificated he put the 16th so now since that is what has been used for everything all my fiancee's records say he was born August 16th. My fiancee doesn't have a birth certificate and I've searched on here and couldn't find anything about alternatives. What qualifies as a legitimate birth record when applying for a K-1 in regards to India? Can he use his 10th certificate? Do we need to try to obtain a birth certificate (which from what I am finding are still hand written so I'm not sure how much weight that is going to carry)? Or is there something else we need to do to prepare for when these documents are needed?

January 2009 - K-1 Denied by the consulate

January 2011 - Moved to India - Yikes!

October 2011 - DCF filing rejected by overzealous employee at the embassy

December 2011 - Tourist visa denied (not surprising)

March 2012 - CR1/IR1 process started

May 1, 2012 - RFE and some of our information was entered into the computer wrong by the CSC

If you can't obtain another birth certificate from the registrar's office of the place your fiancee birth was recorded at, then you need to get a 'non-availability of birth certificate' from that office, and also need to get affidavits from parents, and other family members.

My husband doesn't have a birth certificate either, and we were unable to obtain a "non availability" certificate which is supposed to be necessary (the issuing office refused - I think they wanted a big bribe!). We got one Affidavit from his mother (father deceased) which was signed with a thumb print because she is illiterate. Along with the Affidavit, we sent in his 10th certificate and also a caste certificate. It went through fine, no questions asked. When he came to USA, for SSN, ID, etc., all they wanted to see was his passport. No one asked for birth certificate. For AOS we sent in same Affidavit and 10th class certificate we used for the Consulate in India.

As a side note, he said he was actually born Oct 10 but when he signed up for 1st grade his grandfather didn't know when he was born so the headmaster wrote down July 1. And that's been the official date on all his paperwork since! :lol:

I would suggest trying to get the "non-availability" certificate and if that doesn't work, get your fiance to gather up as much paperwork as he can showing his date and place of birth and father's name. Hopefully India will accept it and here in USA, you won't have a problem because passport is most important.
