Hi. I've been deported last nov. 2004 for overstaying( 1yr and 3months) and back dating the passport. I was banned to enter the US for 5yrs. After the long waited I got married last yr 8.8.08 ... my husband returned to US after a month and filed the I-130 petition and luckily approved after 2months. Now we are in the visa processing and waiting for the next step.. I know that i needed to get a waiver before I can enter to US. The question is what are the circumstances that I will face coz I read for in the forums that the hardest part is to pass the fraud waiver. Any suggestions so that as early as this we can prepare and gather all the documents that may needed in the future.. tnx in advance.. hope to hear from any one of you..

08.08.08 : Got married in the Philippines

09.08.08 : My hubby returned to USA =(

USCIS

12.08 : I-130 sent to USCIS

12.11.08 : NOA1

02.23.09 : NOA2 approved!!!

NVC

03.03.09 : NVC Received/assigned MNL case no.

03.17.09 : Received AOR IV/AOS FEE by email

03.23.09 : Paid AOS and IV fee ($470)

03.25.09 : NVC received payment

04.02.09 : Received instruction packet lawyer I-130

04.29.09 : NVC received DS-230, & I-864 (Case in progress)

05.08.09 : NVC case completed

06.02.09 : Medical (passed!)

06.15.09 : Interview Date (denied) =(

better take a advice from lawyer, my brother-in-law has the same problem but he never been deported from USA and later got married with USA citizen and now they are using a lawyer to fix it and in process.

Your 5 years is up in November this year - no? You might be faster and cheaper waiting that out than having to go through the waiver process. Manilla is a tough one to go through I believe and it takes time.

Someone with more direct knowledge should jump in here...
