hi,

i apologize if my topic may sound out of the n400

discussion,

i met a friend over the week end and he asked me if his

green card obtained in 1981 is still valid, meaning if he still is a permanent resident

on a brief conversation he told me he has been out of the states for over

20 years but he would still be interested to know if his gc allows him to

reenter live in the us

looking at his gc i dont see an expiration date, there is the a# ,

ihave his ssn# and day of birth, is there a way to check his immigration status throught a web site or by calling the cis?

thank you all

He abandoned his permanent residence when he left the country to reside somewhere else.

Yep, the person is no longer a permanent resident, specially since in all these years there was no renewal of the GC and the fact he's lives outside the US for 20 years.

the card does not have an expiration date,

are we sure?

maybe back then the regulations were different

with no expiration date, technically it should still be valid

pls advice

Even if the card had an unexpired date, but they were outside the U.S. for more than 1 year without a reentry permit, the residence is abandoned. It's not about the expiration date--it's about being outside the U.S. too long.

Consider for clarification that someone had just received a 10 year GC and then leaves the U.S. for over a year and then tries to come back after 1 year. The card does not expire for over 8 more years, but they are no longer permanent residents because they were outside the U.S. for more than 1 year without a reentry permit.

There is also a requirement that to maintain residence you have to file U.S. tax returns for your worldwide income. Have they been paying U.S. taxes????? If not, they abandoned residency on those grounds as well.

Further, have they maintained a U.S. address? A U.S. bank account? An apartment or home lease?

Back then GCs did not have exp dates. The requirements were a bit different back then. There is no place to check to see if it is valid still. USCIS will not check over the phone. Now he has lived out of the US for 20 years, I would run it past a US consulate or embassy to see what is if they can do anything or check it out for him. (Call Them) I personally dont think that he would be denied entry into the US, since the Alien number and his card is valid without an expiration date. Just my 2 cents.
