thanks for all the kind words and thoughts. I'm really trying to stay sane right now without breaking down and crying again. i haven't even felt like eating in two days. i've been nautious, headaches from crying , and just feeling so lost. And i yelled at poor david and snapped at lawyer and kinda had a meltdown.

how can they play with peoples lives like this..i just don't understand. first they tell us fbi background checks, and that it will take another 5 months from july, then we get congress involved and i miraculously have an noa2 within a week, now they decide nope were sending it back, and now i'm wondering if my file is going to get lost in a black hole being sent back and forth while one says approved and the other say no.

and the whole while all we can get out of anyone is incomplete documentation. BLURGH! so help me is uscis fvcked up, grrrrrrrrrrrr.

But at least my other march filers are doing better. glad to see some of you have your interviews and it's almost over for you!!

The last time I called USCIS to get an update I was told to call back in 17 days. Today was the magical 17th day.Who would have thought?! I called back today to find out that...

Type of service requested:

The status of this service request is:

The processing of your case has been delayed. A check of our records establishes that your case is not yet ready for decision, as the required investigation into your background remains open.

Until the background investigation is completed, we cannot move forward on your case. These background checks are required to be completed on all applicants who apply for the immigration benefit you are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete. If you do not receive a decision or other notice of action from us within 6 months of this letter, please contact us by calling our customer service number provided below.

If you have any further questions, please call the National Customer Service Center at 1-800-375-5283

Hmmm that's strange...This is the exact same thing I was told when I called 17 days ago...except now it's call back if I don't hear anything for 6 months. Really?! lol What a joke. I wish there was something I could actually do that would impact those that are complete ridiculous with this.

Is there somewhere I can call to understand what the delay is for in the background check part of the process?

This is the USCIS version of "the check is in the mail." It's their standard response to any delay, but as with a check in the mail, it just might actually be true in some cases. If you have not done so, please contact the "constituent services" division of your Congressman's office. In all likelihood, these people will get the same answer, but history (including our case) has shown that it can actually get the case moving along. After no activity for nearly 5 months and then initiating contact via our Congressman's office, our case has made it all the way to the consulate in less than 3 weeks!

Binow..definately get in touch with your congressman. Only he can find out the true reason your file is delayed. Many of us were told background checks and that was not true.

Yes, your congressman of Senator. Once a congressional inquiry is submitted, the USCIS has 3 days to respond.

In case you didn't see my post in the other forum, just wanted to let all of the March filers know that there is light at the end of the tunnel. We were approved for the visa this morning! I will submit an interview rating later, but all went well. It was over pretty quickly and the questions were simple just about our relationship and what he does for work. :dance: I can hardly believe we have made it this far! Next month we will be together! Good luck to everyone else!
