Timeline

my fiancee is currently laid off right now but he is receiving unemployment which is $350 per week and subpay which is $300.

is this okay to pass the minimum poverty level?

we are also going to have a co sponsor. i know the co sponsor will depend more likely with the consul..

in additional, his ITR for 2006 and 2007 are of above poverty level..

is this good?

also, Dan has requested for the extension of his ITR 2008.what if the interview is after April 15, should we wait before we get the ITR 2008?

thank you

ps. do we still need to get employment letter even if he is unemployed?

Wow, im not sure. I know that co-sponsors help. But the whole point of the affidavt of support is so the intending immigrant does not become a public charge. If the USC is a public charge, there is a good change that the intending immigrant may be as well. Does the intending immigrant have any proof that they can get a job here? i know that my husband has had h2b visas here in the past, and i included that with all my affidavit of support, along with my information and my co-sponsors. I think if the co-sponsors make enough say, for themselves, (their dependents) and the intending immigrant, check the 125% above poverty level chart, then i think you should be fine. just look at how much the co-sponsor makes/owns and look at how many people they have as dependents and also the intending immigrant. if they make 125% above the poverty line, i think you have a better chance, but im not sure. Any body else have imput?

If it is a temporary lay-off, you can try and get an employer letter that shows his prospective earnings for 2009. You can try just showing the 2007 return, but they will want to see his wage and earning statements for 2008, so it will be hard to get past that if he did not make enough in 2008. See if he has any assets, like property, or savings. Make sure you have an I-134 filled out by your co-sponsor ready to go.

Why is he filing an extension?

He could start his own business for 2009 and do a DBA and put his expected income on a employment letter...

Problem now is USEM COs seem to be denying the use of co sponsors a lot more recently.

If that happens the petitioner will have to have proof that he will have a source of a steady income in the near future.

I wouldn't recommend getting an tax extension unless he has a GOOD reason.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Dan used to work in GM..as we all know the 3 big car companies are asking help from the government..

as for the extension, he is requesting for an extension because if he file tax for 2008, they might see that he did not file his tax last 2005 and hence, he could pay penalty..When in fact, it should be his ex wife who should file the tax for the year 2005. They asked the ex wife if she already filed for it and she said yes..Later they found out that she didnt file it. Thats why he is asking for extension.

his 2007 tax return was about $56,000 and for 2008 in his w2 its about the same too $56,000

Hi, your interview is quite far i am sure that your fiance could find a job by the time that u will be having your interview. In my case, my fiance was laid off during my interview but he was able to get the employment letter from his previous employer and also he sent me earlier the affidavit of support and it was fine. Try to let him find a new job. Good Luck

May as well file. It would look good to USEM if he showed $56,000. They do go by how much the petitioner made in the most recent year and you guys shouldn't have any problems. Bottomline if USEM won't accept a co sponsor that's your best chance.

Can't run from IRS forever. Failure to file isn't looked at with much favor by IRS. Longer he waits the more the penalties stack up!

so now since he is laid off, and we are depending on his unemployment and subpay, is that fine too?

As what I am aware of, I don't think co-sponsors are allowed in K1.

(Somebody correct me if I'm wrong).

Hi were on the same situation.My husband is currently unemployed and receiving unemployment from the gov. We have a co sponsor which is his dad and hes getting enough. But im still worried coz i read a lot of post some say yes its ok and some are not. Our plan is when i get my visa my he will use the benefit from the army and go to school which is enough for us while im looking for a job. SO worried i cant even enough sleep thinking if im going to have a visa or not. :crying:

Uhm, $350 * 52 = $18,200 which is above the $17,500 125% of poverty level for 2. Add the subpay and the sponsor is close to double 125% of poverty level for 2.
