Hi All,

I'm just wondering whether the previous IRS Tax Forms and W-2s are mandatory requirements for the Affidavit of Support (I-134). I was unemployed for about 16 months, from July 2007 until November 2008. I went to school full time to finish my degree and basically lived off my savings then. I started working again on Nov 2008. My question is whether it's okay to submit along with the I-134 just the Employer Letter, recent copies of paystubs, and statement from the bank???

I can still show my 2007 and 2008 tax forms which will show very minimal income for that year since I only worked for about 6 months in 2007 and about 1 month for 2008. I only had about $16,000+ earned on 2007 and $3,000+ on 2008.

Again, I am currently working since Nov of last year and have a yearly income of about $32,000. I know I am above the poverty level, but I am planning to just submit the Employee Letter, paystubs, and bank statements. Is this okay?

Our journey:

Aug 13 08 - introduced over the phone by her best friend (conference call)

Aug 14 08 - 2nd conference call

Aug 17 08 - our first one on one talk

Sep 13 08 - told her I'm falling for her

Sept 20 08 - Jamie's bday, surprised her with gifts

Oct 30 08 - went to the Philippines to meet her

Oct 31 08 - "I love you"

Nov 18 08 - went back to the States... saddest day of my life

Jan 03 09 - filed 129f

Jan 05 09 - CSC received petition

Jan 06 09 - NOA1 notice date

Jan 10 09 - NOA1 received via US mail

Mar 14 09 - RFE

Mar 19 09 - RFE Received

Mar 20 09 - RFE reply sent to CSC

Mar 25 09 - CSC received RFE

Apr 08 09 - NOA2 date

Apr 11 09 - NOA2 received via US mail

Apr 14 09 - Case forwarded to US Embassy in Manila, Philippines

Apr 22 09 - Scheduled Interview (got May 20 interview date)

May 04 09 - Medical Day 1

May 05 09 - Medical Day 2

May 20 09 - Visa Interview

Tax transcripts are not *required* for the I-134, but it is recommended you include them anyway. (unless if your self-employed, then they are mandatory)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Perhaps, but even based what you "quoted" indicates one year of tax return or a Dunn & Bradstreet rating (ie. commercial rating concern) ... IRS transcripts are not even mentioned.

There are two choices but in many cases, people would much rather provide a tax return than pay Dun and Bradstreet to do a rating.

Tax transcripts are your returns. Either one will work.

I agree the either will work but, a tax transcript is a little different than an as filed tax return...

Most needs for tax return information can be met with a computer print-out of your return information called a "transcript". A transcript may be an acceptable substitute for an exact copy of a return by the United States Citizenship and Immigration Services and lending agencies for student loans and mortgages. A "tax return transcript" will show most line items contained on the return as it was originally filed.
