I-864 and tax returns

Guys,

huge dilemma for me!

We are working on I-864 ....we want to file 2008 taxes together - I was working in the US last year and i have my SSN. However I cant find my State return from 2007 to file return for 2008!

Our friend is working on our taxes and tld me that he needs that info!

Is it a bad idea to file married but separately ? I thought that would be a good evidence of bona fide marriage but in this case our NVC process will slow down!

Does my hubby need to have filed taxes for 2008 in order to file the AOS for me now? We will have joint sponsor as well - the joint sponsor filed taxes already.

i dont know what to do :(

You do not need your 2008 tax return if you give them the affidavit before April 15. They cannot force you to file a tax return before that date, so obviousy you won't have it if you elected to wait closer to the tax deadline :)

You might want to include a note saying you haven't file your 2008 tax return so there isn't an RFE.

i will file it together for sure its just the matter of time

my joint sponsor has last 3 years covered so i think that's the most important thing!

and i havent paid the AOS fee bill yet so its not like a big rush right? it takes some time before they send the AOS package

Depending on your income married filing seperately is almost always going to cost you ALOT more in taxes than if you file jointly. If it were me I'd rather wait a few weeks than pay thousands more in taxes.

Your tax preparer may want state returns to prepare your taxes but you dont file state returns with the I-864 they are only interested federal returns.

While it is true they can't force you to file your returns early it is also true that they can issue a RFE requesting your 2008 return after April 15.

As you have a cosponser domonstrating the Petitioner has filed for the last 3 years is most important rather than income.

Depending on your income married filing seperately is almost always going to cost you ALOT more in taxes than if you file jointly. If it were me I'd rather wait a few weeks than pay thousands more in taxes.

That's true! They can issue the RFE after 4/15 but by then we will have everything done!

I want to make it clear! nothing shady or something like that!

Yup, since my wife's interview will probably be after April 15th, I am working on my tax returns at the moment, to ensure that I have everything, in the event that she gets asked the question at the interview.
