Married 2 years ago and got my 2 year pernament resident card.The marriage only lasted a year due to different outlooks on life and stuff like that.We ware divorced and still talking and get on fine.It was a totally in love marriage but it didnt work.Now i must apply for the l751 waiver as it is approaching the 90 days.I would really like to know what would be the best way of going about it?Should i het a lawyer to do it or shouild i just file myself?i have been here 4 years now and love it.Even when i got my resident card i never left the U.S.This is my home now and i really dont want to mess it up.So anyone have any idea's about the best thing to do?

If you can bring a mountain of evidence that you entered the marriage in good faith, I would file without a lawyer. Having a cooperative ex will greatly aid in this. I'd get a notarized letter from your ex attesting to the story.

Should you encounter difficulties, then a lawyer is advisable.

This is only my opinion, however.

Why did you wait until now to file? You became eligible to remove the conditions by way of a waiver as soon as your divorce became final.

Sorry to hear about the breakup!.. I'm on the other side of the 2 year card. We applied to remove conditions last year and I should have the 10 year card by the end of this year with some luck. The wife and I are in the process of splitting up as well.. we too ended up moving in two different directions in life... well her more than me! We're actually still stuck in the same stupid house till we both find somewhere else to move so it's very weird at the minute but calm.

....here is an update on my situation .........i am 4 days away from the end of being within the 90 day ruling ..i have filled out my I 751 thingy and i am gonna send it overnite post tomorrow,i have no avidavids.and no real prove that the marriage was 'Bonda Fide'except that it was.To be honest i really left all this late. I was thiknong that i had a month to play with but i was wrong.i will have to drive 180 miles in the morning to pick up my divorce papers and sent in the rest of the paper work,which at the moment is looking pretty sad.But i'm hoping that honesty will prevail andif it hits the fan that in the long rum it will work out fine plz god ......

You should try to gather as much proof as possible, even after you send out the petition. Chances are you could be asked to provide evidence later on. Honesty is nice but honesty alone is not gonna fly. You're going to need real hard evidence: pictures, bills, bank statements, credit card statements, etc. It's not about proving whether you loved each other. It's about proving that your lives were intermingled legally and financially. If there's anything that I learned from this experience, I learned that preparation is the key. I tried to be organized and prepared myself for the best and worse case scenarios. I tried not to leave anything up to chance. That's just me.

Note that, if you're applying based on a waiver, there is no specific time window during which the application must be filed. In particular, the 90 day window becomes pretty much irrelevant.

Obviously, if you allow your green card to expire before filing, you're left without proof of status, so it's wise to file before green card expiration if possible.

But I believe the official rule is that the application may be filed any time after the divorce is final and before removal proceedings begin.

05 Apr, 2004: I-130 Sent to CSC

13 Apr, 2004: I-130 NOA 1

19 Apr, 2004: I-129F Sent to MSC

29 Apr, 2004: I-129F NOA 1

13 Aug, 2004: I-130 Approved by CSC

28 Dec, 2004: I-130 Case Complete at NVC

18 Jan, 2005: Got the visa approved in Caracas

22 Jan, 2005: Flew home together! CCS->MIA->SFO

Regardless how long you have to drive, you need to get the divorce decree in order to apply under the waiver. Be aware that not necessary becuase you file on time "you are safe" , they may or not received your application or later on ask for a RFE. It's totally their call.

First is first, why at the time of divorce you did not get a copy of your divorce decree, don't know...I know that many state/county, etc are different, but most commonly I think it is an important paper to keep as a bill, you know...for your own records.

You say that the only evidence that you have is practically your word? Do you guys were living together, right? What about the lease, mortagage, bill or something in both names? bank? did you keep all separate? You never make friends or meet his friends? what about your friends? Do you have insurance? cars? or all was keep in one person name? Many things are kind of the same story that you got through AOS...so no surprise here. There is no surprise that the process with USCIS wasn't going to end or be different with just the conditional GC. Believe me I did not like to get many things in both names becuase it was just non sense, many people who are totally in bona fide marriage have things separated, but that's the way it goes in USCIS eyes, so if they say baseball you play the ball. You at least were married two years, what about the tax returns? I hope you file married jointly.

You can do a search in this great forum and find a LOT of experiences with waiver and what people did.
