Still no greencard here!

We called USCIS and the lady only told us that we had to wait a while (not stating any specific amount of time) and that she didn't know anything else. :huh:

My husband is going back to Spain on Sunday and we figured it would be here by now. The notice says within 3 weeks, well Monday is three weeks :(

I hope his notice will be good enough for re-entry!!

It will not be good enough for rentry. He must have the card or AP document. I suggest you reschedule the trip and wait until the card arrives, or wait and make an infopass appointment and get a I551 stamp in the passport, prior to leaving. He will not be allowed back in without the stamp or card.

He has an AP document, so that won't be a problem. We just weren't sure what they were going to ask for because his AOS has been appoved so maybe the AP docs weren't necessary. Well, he has what he needs, I'm sure, we were just hoping for the actual greencard so there would be no worries on our part.

October 27, 2008: K1 VISA RECEIVED !! (233 days - 7 MONTHS 19 DAYS)

January 17, 2009: Entry - POE: JFK w/EAD (315 days)

February 6, 2009: WEDDING! (335 days)

March 24, 2009: Sent AOS, EAD, AP package to Chicago Lock box (381 days - 1 YEAR 16 DAYS)

June 30, 2009: Interview in San Jose, CA (479 days) - NOT approved, Sworn statement required

AUGUST 14, 2009: GREEN CARD IN HAND (524 days - 1 YEAR 5 MONTHS 6 DAYS)

May 31, 2011: Sent I-751 Removal of Conditions package (1179 days - 3 YEARS 2 MONTHS 23 DAYS)

January 25, 2012: 10-Year Green Card Received (1418 days - 3 YEARS 10 MONTHS 17 DAYS)

Chances are he will be allowed back in with AP. AP is not guaranteed (read the AP), it is up to the border officer. It is best to get the stamp, or have the card, prior to leaving just to make sure.

I'm still waiting on mine...

At least I have the EAD! I got it in the mail the other day; the plastic window on the envelope was melted off for some reason, and that worried me a little. I was excited though!

Anyway, I do have a little problem...

I would love to travel to the different states and take in the sights of my new adopted country (I am currently in process with the I-485), but am at a loss as to which identification I should use.

I have:

Passport issued by the Republic of Singapore with my maiden name

Employment Authorization Document (EAD) issued by the US Department of Homeland Security and the USCIS with my husband's last name

Marriage certificate to prove my taking of my husband's last name

Notice of Action on Adjustment of Status

Which should / can I use to travel domestically? Will the EAD be enough, or do I have to bring everything? I really do not want to lose everything in the event of a theft or something similar, so I want to travel with as few documents as possible.

I'm SO CONFUSED! >_<

You could just bring your passport. I travelled to 4 different states prior the issuance of GC, all by plane. Had no problem with different domestic airports.

Regarding the AP documents, please read them carefully. They do not guarantee re-entry, no more than a regular visa. Our attorney advised Angela NOT to leave the country even if she had the AP. AP's are sometimes given to people who are not entitled to them in the first place, as posted several times on this forum in the past. Even an Immigration Officers made the remark to a VJ'er that he/she should not have gotten the AP.

Of course, if you have no reason to be denied entry - like no previous visa overstay (and you got really close when you applied for AOS right before the 3-month K1 expiration date) or no more than 6 months in the country during a calendar year or you did not use government funds while traveling (health reasons for ex.) - , then they probably would let you in.

As to the AOS approval, it doesn't mean anything. If it did, they would not require us to get an I-551 stamp in the passport. Think about it!

You may have a one chance in a million to be denied entry, but I would still go spend the hour in the USCIS office to get that stamp if I were you. Moreover, it's free.

Tania's interview was this morning, and it went fine. Aside from asking the checklist questions, the IO asked about how we met, how our relationship developed, and asked us each some questions about the other's family. The only thing she asked to look at were the documents proving our residence together and that we have a "bonafide" relationship. The whole thing took about 10 minutes. The IO checked the interview form as "pending further review" or something like that. Turns out that because the IO was a trainee, that was all she could do. The supervising IO, who oversaw the interview, said that she will approve the case later today without question. We asked for and received the I-551 stamp in Tania's passport. They didn't keep any of the documents or copies that we took, not even her EAD or AP documents. The supervising IO said that we should expect the GC in a couple of weeks.

BTW, the case finally showed up online about a week ago.....status was "case received and pending". :)

Thanks Paul. BTW, I checked the case status online this morning. It was updated to show "card production ordered" on Aug. 26. I'll update when the card arrives in the mail.

Well, I just got news on CRIS that my new permanent resident status has been registered, and that they had a "Notice mailed welcoming the new permanent resident".

So... do you get this before the interview? Or is this the welcome letter you're supposed to get after? I didn't see anything in the thread in regards to that, and I don't want to be too excited yet.

That's the notice you should get after the I-485 has been approved (typically after the interview), and that should mean the GC is on the way. Have you had your interview? Was your case transferred to the CSC? If the latter is true, there won't be any interview.....just the GC. Your timeline doesn't seem to be up to date.

But my case was transferred to the CSC, so does this mean I do not have to go through the interview? If that's the case, GREAT! xD
