AOS FILERS: MARCH 2009

Ok. I think we were past 180 days when we filed our AOS. I'm too lazy to do the math, but it was close.

But since she now has AP, and has received her NOA1 for AOS, its ok for her to travel outside the country and come back. Correct?

Oh yea, she received her AP today. Still waiting on that EAD so we can changer her name of the SS card.

If you already have an AP, read the part " travel warning regarding unlawful presence".

It says there, "if you were unlawfully present in the US for more than 180 days after April 1, 1997, you may be found inadmissible when you return to the US."

If you are past 180 days, i would have second thought in going out the US before AOS approval.

After you read the portion i mentioned and I'm wrong withmy understanding, do correct me.

This is my understanding:

You will have an out of status if you filed your AOS after your I-94 expired. If you are out of status for at least 180 days , even though you have an approved AP and left the US... you might have a problem with your re-entry. The 3-year-ban could be imposed.

Okay, so if my husband was only out of status for about . . . 2 weeks or so, that shouldn't be an issue?

I know 2 weeks will not be an issue .

Though portion "travel warning regarding unlawful presence" in AP highlighted that "obtaining advance authorization for parole will not relieve you of inadmissibility under 212(a)(9)B(i)

I-131 (AP) : Your case can not be found at this time in Case Status Online.

Should I start to worry?

I hope you did not wait until now to get a credit card and build your credit :)

You just need a Social Security number to get a secured credit card. We went to Wells Fargo shortly after Angela got her Soc. Sec. card with her new married name, no problem.

Finally I was able to check online about My Husband AP online. I checked yesterday was not there anything but..Gueesss!..I try put in our case no to USCIS website & that's worked...

Its Approval on 28th April..only AP was sent..

But waiting for our EAD too ..No status on EAD yet hopefully both at same time..

Hey Congratulations!!!!! I keep checking mine on USCIS everyday but other than the GC i am not able to see anything on AP or EAD, everytime i check with the receipt #'s it says case not found. May be they have still not updated the detailson USCIS. My case got xfrd to CSC. Which means hopefully i wont get an interview.....

Hoping for speedy approvals for all Vjer's
