Yippy i recieved my Employment Authorization Card in the mail today, took just a month and a couple of days from filing... waiting for my interview letter or transfer which hasn't come in yet.

We never knew it would be a card as the AP was just a letter like the NOA, was shocked to see the card and it looks all fancy.

That was fast - congratulations! :star:

very true... am just waiting for my honeymoon now, once we have the GC we are off to UK for 6 weeks.

I did have a question and was wondering if anyone could help or explain the circumstances i would have to face, I continued working when i moved to the states, I DID NOT HAVE AUTHORIZATION or i did not get any stamp at the POE... my employers wouldnt let me leave them and wanted me to work while i was being paid per US standards... now what about my taxes for the next year ? will the IRS find out ? what will be my next steps ??? and am feeling guilty for what has happened but i dint have the faintest idea about how this would turn out as in India we dont need any authorization to work... I work from home as a web trainer and support for the website used in schools to text message parents.

I have heard from many people that the 'working without permission' is forgiven. Once you submit your AOS paperwork, your pretty much home free. They dont really bother you. Even if they know they rarely ever go after you because you did everything else right, you married a US citizen, and submitted the AOS stuff and got your greencard, i wouldnt even worry about it, file taxes as normal, if you have any more questions about this, i can give you more direct answers if you PM me.

Good to see EAD cards are starting to show up...

As for working... I'm assuming you work for the same company you worked for before moving... it's perfectly OK for immigrants to continue to earn income from sources outside the US (and it's even possible to provide an affidavit of support for yourself if your income from outside the US will continue). Wether or not it can be an issue is really a matter of technicalities I think, if the company doesn't have US offices then clearly you aren't working illegally as you are working outside the US, if they have offices in the US... it's potentially trickier... but I think it's safe to say it won't be an issue since AOS is filed. If the company is taking out federal taxes etc, then you won't have to worry come tax time about owing extra, but I'd say technically you are working illegally... where if they aren't taking out american taxes... then you probably are working legally, but I think you may owe US taxes on it when you file... I'm no expert, so good luck and hope it works out, tax laws are complicated enough for citizens with 'normal' employement, adding in immigration specific fun is only going to make it harder.

I am still waiting for a Biometrics appointment. Have called USCIS a few times, and they still don't have my case number showing up. They said sometimes it takes 45 days. They escalated me to a higher support and they told me just to check back every week with them. Like I have nothing better to do...

As long you are not hired in the US even though the company has a US office or US based, then technically, you dont work under US.

Got this comment from the CO that interviewed me.

The main question here is that, are you hired here in the US? If not, then you dont violate your restriction. PM me if you want more explanation on this statement.

thanks for all your comments here, this forum really helps :)

No, i was employed in india and dint quit since then.. am working as a free lancer here where my salary is paid without my taxes being cut.. am to be paying taxes and they will give me the 1099.

I hope this info helps and i should be okay working as what you guys have told me, that relieves me and lets me concentrate more on my job now :)

THANKS EVERYONE FOR THEIR SUPPORT

I got my AP and EAD coz i had asked for it earlier than you guys, my case hasn't been transfered nor do i have an interview date so be patient and dont panic... and yeah my case cannot be viewed online either and that doesnt worry me cause the agent we spoke to said there is a lag and thats the only reason why and doesnt effect the case processing as the USCIS has an internal system which they use apart from CHRIS :)
