I'm addressing this concern to all those who have undergone the same. I'm supposed to submit a police cert from china since i worked there for about 9 months on a Z visa. I had my interview already at the US embassy manila and was told to submit this. Problem is I can't supply this doc. My former employer refuses to sign me my employment cert because of my untimely resignation from work (because i had to pursue working on my visa papers) which unfortunately for me is being asked by local police in China as per policy. I have called, written, appealed and even called the phil consulate in beijing but was told that they can't help me..anyone here knows what the embassy can accept in place of police cert???? My fiancee and i have already written to the embassy and explained our situation but we are still waiting for feedback up to now. I went to the chinese embassy makati several times but all i got was a very abrupt the embassy does not issue police certificate. Any advise on this will be really really appreciated

Police Records

Generally available, reliable. Persons should apply for a certificate of no criminal record at the local Public Security Bureau (PSB) (or certain types of employers such as state owned enterprises), then make application to the notary office for a certificate based on the PSB document. Persons without a criminal record will be able to obtain a certificate to that effect. Certificates for individuals with one or more criminal convictions will list all convictions for which records still exist. The certificates purport to reflect all criminal convictions during residence in China. Police records are generally not available for the period prior to 1949. Certificates are available for those in the J-1, Z, and X categories. The GOC does not issue police records for temporary residents of China in L or F visa categories.

Police records also are not available for those who were in China in diplomatic status including those working for international organizations such as the United Nations. Notarial police certificates are based in part upon records from an individual's employer. If an employer refuses to release records, the notarial office is not able to issue a certificate. This is the case for persons sent abroad for education by the Chinese Government who fail to return to China.

Thank you for your assistance. I'm writing again to the embassy and will cite the last part mentioned in the reciprocity schedule -Notarial police certificates are based in part upon records from an individual's employer. If an employer refuses to release records, the notarial office is not able to issue a certificate.- this is my case. I was in China on a L visa from Feb 2007 to April and on a Z visa from May to January 2008. My former employer is refusin0 to issue me my COE because of my untimely resignation. Just really hard to talk to them. They don't care about anything and refuses to understand my situation. Hopefully, the embassy will understand and make a favorable decision on our appeal..
