Hi guys,

It's not easy for me to write these post but i believe those people who prayed for me needs to know what's going on with my case.

After 5 months of waiting the result CO finally made his decision...My hubby came here last feb. 20 for his 3rd visit and for our 1st wedding anniversary. We went to USEM Feb 24 to talk to the CO and fortunately we did. He asked some questions and later explained about the problem. He told us he believe that we married because of love and not for any reasons but due to the technicalities from the marriage license he could not grant me the visa. The options we have is either to get the marriage void and re-marry again or void the marriage and file for K-1 but it's better for us seek for immigration lawyer's help. But as for the CO ( he is a vice CO anyway), he wants to pursue the case because nanghihinayang sya.

Inspite of what happened, we are so thankful to the CO for believing on us and for sharing some infos.

His marriage has been finalized march 2007 and we got married feb 2008...

We didn't file the marriage license in person. My aunt who filed the license told us there's no need for personal appearance. No PA, seminar, someone forged my signature, not a resident of San Juan ( i'm living in iloilo since then), and typo error of the filing date ( feb.11 instead of feb 15.)

ohhh ..im sorry about that..but i just wondering why, if u have genuine marriage and marraige cert.and proof of ur relationship after married.anyway just keep praying and good luck!!!

Sorry to hear about your case. Getting an annulment in the Philippines is a very tedious process, I went through the same thing because of some technicalities, we had our first marriage voided thru annulment, a year and 150thou in expenses later, we got married again after annulment was finalized. Married my hubby twice.

what was the problem with technicalities? Is it a typo? Or, what? Because, our marriage certificate also has a typographical error, but we already filed a petition for clerical correction and was approved, and we got our annotated marriage certificate copy from NSO. Would it be a problem? Thanks!

I feel sorry about what happened too. It's about technicalities and it's a big question if you came in the US , dates which doesnt coincides. You can refile do the CR-1 visa. I heard from a friend of mine there was a K-3 denial on the first application then refile it but went to CR-1 .She is approved.Do that, maybe void the 1st marriage and remarry. Please ask Atty. Gurfenkiel about it .

some people do this in pi..they dont follow the normal process...in some people it work but in some like yours didnt...i feel sorry for you..

i was sent to fraud also coz the co didnt believe that its a true relationship because we dont have chat logs and emails...good thing we followed the normal process of getting marriage license and attending the seminar even my husband find it so boring and useless and waste of time..

we only waited for one month for the approval of my visa..so just dont give up and just keep on praying...i think there is a reason why it happen to you.

Sorry to hear about your troubles.

If you didn't appear in person for the license, was your signature forged by your aunt? Usually you have to be there to sign it. I don't think you can get around that.

Perhaps you can go to the court where your license is, and have them re-do it, this time, with your real signature?

Thank you for sharing your story, this will help people to know that if you try to cut corners by not following established rules/law, sometimes it will catch you.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
