ok, not sure if this is the right forum, but wish to get a little help. Im a male from central america, came here when i was 12 yrs old, im 22 now, and didnt qualify for tps. (i came july 29, 1998). I graduated from high school with full honors but havent been able to adjust my status. I wonder if is true im able to adjust my status by the ten years rule, I heard there was somthing like it. Anyone knows???

I am just trying to help you . Please write in more details so that other senior members can help you more. Did you enter US with proper visa and inspection ? As far as i know there are some eligibilty criteria under Temporary Protected Status .

Who is Eligible for TPS?

An alien who is a national of a country (or alien having no nationality who last habitually resided in that country) designated for TPS is eligible to apply for TPS benefits if he or she:

• Establishes the necessary continuous physical presence and continuous residence in the United States as specified by each designation;

• Is not subject to one of the criminal, security-related, or other bars to TPS; and

• Timely applies for TPS benefits. If the Secretary of Homeland Security extends a TPS designation beyond the initial designation period, the beneficiary must timely re-register to maintain his or her TPS benefits under the TPS program.

An alien is not eligible for TPS if he or she:

• Has been convicted of any felony or two or more misdemeanors committed in the United States;

• Is a persecutor, or otherwise subject to one of the bars to asylum; or

• Is subject to one of several criminal-related or terrorism-related grounds of inadmissibility for which a waiver is not available.

Now see if you are barred under any of these clauses. Also what happened when u tried to adjust from student status ?? pls write in details ...

March 13, 2009 : Checks Cashed
March 13, 2009 : NOA 1 received on I-485, I-130, I-765. Dated March 11th, 09
March 17, 2009 : Biometrics Letter recieved (Dated 13th March). Interview on 1st week of April
April 2, 2009 : Biometrics done. Total time taken with wait 20 mins.
April 22, 2009 : Called USCIS. They have received fingerprints and work permit is in process.
May 7, 2009 : I-765 case online. Card Production ordered.
May 11,2009 : EAD card received.
May 12,2009 : Applied for SSN.
May 18,2009 : Received SS card.
June 08,2009 : Received Letter for Interview ( scheduled on July 14 th July )
July 14th : Great Interview. All done in 20 mins.
July 18th: Online status - Card Production ordered. Thank God !! I-130 online status : Pending
July 23rd : Welcome to USA & I-130 approval letter recieved. Online status still shows pending.
July 31st : Received conditional green card
Removing Condition
3/25/11 - Received reminder from USCIS to file for ROC
5/6/11 - Sent I-751 Packet to CSC via usps
5/9/11- Package delivered to csc.
5/11/11- Check cashed electronically by CSC
5/16/11- NOA 1 received
5/27/11 - Biometrics letter received.Scheduled on 06/06/11. Case Online
6/6/11 - Biometrics done
9/6/11 - Approved.Card Production Ordered
9/12/11- Card Received

10/16/15 : NOA

11/13/15 : Fingerprints

11/17/15 : In Line for Interview

01/11/16 : Interview- Passed & Given Oath letter & Date by hand

i came in the us with a tourist visa when i was 12 yrs old. and overstayed. I dont have andy felonies or none of the above, i completed from 7th grade until high school, and was never able to apply for a students visa. we are been claimed by my step dad. hes cuban and has been married with my mom for like 5 years, hes just a resident and it has taken really long for us to get our green cards, or even a working permit. im in line with a i130 resident claiming a relative under 21 (since i filled when i was 18). its in california and the line is trough june 10th 2005 i believe. I filled out on december 13, 2005.

You say:

If that's the case, that would implied that you have applied for the green card and working permit and it hasn't come through? But on your first post it says that you haven't been able to adjust your status.....kind of confusing...

Anyway, know of one case where somebody came in like you at 12 years old; overstayed tourist visa; went thru high school, went thru college, and upon graduating college, received a deportation letter. This person hired a lawyer and after 3 years of court appearances and 7k down lawyer and legal fees, he was eventually 'pardoned' by the judge.

Of course, that doesn't help you much, but you should clarify your case. Has your family consulted a competent lawyer yet?
