I have not yet filed a K-1 since my fiance' still has not obtained her annulment from her first husband. The annulment process has been extremly long (over a year now) and expensive, and as of today I learned that her hearing has been postponed till the middle of April.

I met her in person May 11th of 2007 in the Philippines, so time is running out. I suspect that the annulment will not be complete until after this date. Does anyone know how stringent they are regarding this requirement and if they are willing to allow some leeway of a month of two considering the circumstances?

I have substancial proof that we did meet over there. I'm obviously concerned that if we go over the 2 year mark they are going to require that I make another very expensive trip to the Philippines.

I attempted to call the US Visa service this morning at 202-663-1225. Is this the right number to call?

no one can say whether they would make an exception, but you are doing the right thing by not filing the i-129f until the annulment is completed. :thumbs:

Very strict about this, and the consulate can be stict about long lengths of time apart, it would be advisable to visit your finacee again before filing the I-129F

Long periods of separation is a big red-flag

Is now a US Citizen immigration completed Jan 12, 2012.

I think your going to have another trip to the phillipines, they tend to look at those a little closer from what Ive seen around VJ ... also by the time the Annulment is thru it will be several more months and that will well and truely take you past the 2year mark ... When/If you make the trip over make sure you get lots of pics etc as proof of ongoing relationshop also keep phone bills, letters, cards, emails, messenger chats as evidence ...

I would recommend another visit to your fiance.

Let's see. The term "carved in stone" comes to mind.

If the last time you met was 2 years and 1 day ago, your petition will be denied. More correctly, you will be given an RFE asking for evidence that you have met within 2 years prior to filing the petition (your noa1 date) if you cannot provide it, you will be denied. If you send the petition and THEN go to visit, you will be denied. But you could start a new petition and pay another $455.

Yes they will require another expensive trip to the Phillipines.

We actually had a report here last week where the couple was successful with a most recent meeting of two years and ten days before filing. The exception was granted due to the fact the couple had a long standing relationship, lived together abroad prior to the petitioner becoming a US Citizen and if I recall correctly had a child together. The couple also had the complication that the petitioner was without a passport with which to travel until his US citizenship was granted. A pretty unique situation to be sure, and only a ten day exception.
