Because I need the Canadian residency as I am living in Canada untill I complete my degree and pass my exams which is expected to take around 2 years. After that, I am intending to live in the US.

Sorry if I am confused, but what is your end goal? To have Canadian and US residency at the same time? Once the CR/IR visa is granted, you have 6 months to move to the U.S. and then you must maintain residency in the U.S. Why would you spend the money to get your Canadian residency (which also has residency requirements) if you do not plan to use it?

Why would you need Canadian residency if you are a student completing your studies? Residency is for those who plan on making the country their place of residence...you being a student means your residency is transitional/temporary.

You r right, but I do not apply for visa extension, work permit, study permit extension when they expire. The second reason that I am looking for a medical residency in US mainly, but I do not mind working in Canada if I get the residency I am dreaming of.

Ok then I suggest you file Canadian residency which will take up to 1 year. Then when you are ready to move to the US you will THEN file for US residency (no point getting approved for US residency just to let it expire).

Once you cross over to the US you will invalidate your Canadian residency.

One thing a USC must do is file annual tax returns and declare there worldwide income.... Has she done that?

Ok then I suggest you file Canadian residency which will take up to 1 year. Then when you are ready to move to the US you will THEN file for US residency (no point getting approved for US residency just to let it expire).

Once you cross over to the US you will invalidate your Canadian residency.

One thing a USC must do is file annual tax returns and declare there worldwide income.... Has she done that?

From what you're describing you do not meet the eligibility requirements, nor are you ready (timeline-wise) to properly emigrate to the US. Stay in Canada, finish up you schooling, then decide what to do. If US immigration is what you and your wife decide to do, you can deal with it at the time.

I follow the Canadian regulation and my status as a student in Canada is completely legal. I really know what I want as I want to finish my degre in Canada and complete the USMLE (United States Medical Licensing Examination) before going to USA. I expect to complete that in two years. During this time period, I do not want to do more paperwork in Canada by applying to extend my study permit which will expire in 2010

I see, so you did not follow proper Canadian procedures to extend your status there and now want to know about applying to get status in the US? It seems you don't really know what you want to do. From what you're describing you do not meet the eligibility requirements, nor are you ready (timeline-wise) to properly emigrate to the US. Stay in Canada, finish up you schooling, then decide what to do. If US immigration is what you and your wife decide to do, you can deal with it at the time.

Do you know how my wife can make USA as her domicile country. Take into consideration that she did not fill a tax file before, and she was living in Egypt, but she kept visiting USA at least once a year during the past 4 years
