dear VJ users,

We just got the RFE, they are asking about the birth certificate of my wife to prove she is USC by birth, i dont know why they did that, we already sent them a copy of her us passeport.

In the I130 file, i forget to put Tunis, Tunisia in the city and the country in the question 22 (the American consular abroad) also i forget tu put none in my middle name case.

I forget to put this none in some cases in the G325A too.

Do we need to file a new I130 & G325a and submit those informations or we can just write a cover letter and indicate those mistakes????

by the way, they didnt ask about those mistakes in the RFE.

PLZ i need a quick answer, the RFE must arrive to them before march 7.

What exaclty does the RFE say? I suggest you just send what they ask for???

Was the birth cert. of your wife from a civil registrar, or a vital statistics office? or was it just from the hospital? Use one from a Vital Statistics Office.

No need to fill out new forms.

Just something prove she is USC.

When we sent the I130 the first time we submit a copy of her passeport, so i think this time we will have to sent the birth certificate and maybe as said by Karin and Otto, i wont give more things till they ask for.

Hello I got the same RFE on Feb 3. I sent a copy of my husband's biographic page of his passport with the I-130 but they requested one for the I-485 as well (which I didn't know because the instructions did not state that I needed to send one with the I-485). Anyway I sent it off with the letter they sent to the address they asked me to mail it to. Its been three weeks since I mailed it out and my case remains on hold with not touches informing me that they received my letter.

Send them what they requested and don't forget to track the mail. As it is going to a PO Box they are going to send it by priority mail. Again, keep a copy of the letter they sent to you just in case.

same here, they send us an RFE regarding my husband's birth certificate since we submitted the birth certificate issued from the hospital - they want a certified copy from the registrar. We submitted a certified copy of BC, a copy of his passport and copy of his tribal ID since he is a native american.. Until now, still no update or touch.... <_<

You should hear something soon, since you were issued an RFE your case is with an officer, its just a matter of time until he/she looks are your file again.
