Another Hiccup on My Journey...

RFE for I-485

"The Medical Examination that was conducted overseas as part of your K-1 Visa packet states that you have a Class B condition that requies a follow up examination within one month of your arrival in the United States. Evidence of the follow up examination and clearance by the examination from any restrictions on the applicant's ability to support herself as a result of the Class B condition must be submitted. Therefore, please review the information below and submit the required evidence."

First off, I didn't know about the Class B condition and secondly, I didn't have a follow up examination within one month of my arrival cause I didn't know. As well, there is no other information on the sheet.

Anyone know what a Class B condition is?????

it pertains to TB, I have it on my visa in my passport and was directed by the immigration officer at my POE to check with the local health dept for follow up checks (xray and sputum culture test) I had a history of TB treated 4-5 yrs ago

I did so, had xray done at the local hosp (wasnt on my husband's medical yet so the social svcs cleared it for me to be done without paying) and the culture test was provided by the local health dept (I did this at home for 3 straight days and then returned the tubes to their office, they in turn send it back to the State Health Dept for testing)

Hi, I don't think this is an RFE for your filed AOS. Someone has mentioned about mental and physical condition, which I believe is right. This is pertaining to your medical examination that was conducted in your country before the interview. You recieved that letter from USCIS for you to go to a public health clinic for medical examination follow up. The clinic or health facility should be mentioned in the letter or you may call the telephone number mentioned also in the letter. I am sharing based from experience. Good luck.

It is an RFE for the filed AOS. I received an I-797E in connection with I-485 Application to Register permanent Residence or to Adjust Status.

I've been living in Chicagoland for 8 months now. There is no additional information on my document but what I've put in this thread.

I apologize, I made a mistake. Yes, you are right this is an RFE for the filed AOS. If I remember it right, the result of your medical examination FOLLOW UP will be submitted or to be attached together with the filing of the AOS. So, this will be in addition to the AOS required documents. Again, this is pertaining to the result of the medical examination that was conducted in your country during the K1 process. If you remember, the result of the medical examination during the K1, was not to be opened by us. I believe the US Dept. of Health has determined something (a health condition) that requires FOLLOW UP, that is why they (the USCIS ) in the AOS process, require that you visit a public health clinic for that FOLLOW UP examination, and then submit the result with the AOS documents.

I may not be exactly correct, so I suggest you call the telephone number that is the RFE letter.

Just sharing my thoughts.

When I had my medical for the K-1, I was on Effexor for depression. I was taken off these meds last spring and haven't been taking anything since then. I'm thinking that this is the issue.

April 16, 2009 - 2 yr GC rec'd in mail.

March 2, 2011 - Mailed in I-751 to CSC

March 4, 2011 - I-751 delivered to CSC

March 4, 2011 - NOA issued

March 12, 2011 - NOA received

April 14, 2011 - BIO Appt 5/6/11

May 6, 2011 - BIO done in 10 minutes...no re-takes this time :)

June 27, 2011 - Email rec'd "Status - Approved"

July 1, 2011 - 10 yr GC arrived

The bolded section above is what the RFE is asking for. You may need to schedule a doctor's appointment, take your medical records showing the depression medication you were on, and ask if this doctor can issue such a "clearance letter". You can then submit that as a response to the RFE.

Was there anything else included...the underlined statement seems to imply that something else was also included....

Then you must go about providing what the RFE asks for, meaning the "evidence of the follow up examination and clearance by the examination from any restrictions on the applicant's ability to support herself". Schedule an appointment with an applicable doctor and get a follow-up exam. Provide information on your depression, the medication you were on, explain that you've been taken off this medication and have the new physician write you a letter validating that you no longer take the original medication and are no longer suffering from your original condition, depression (I think that's what you said you were on medication for, right?).

I sent a letter priority mail to CSC this morning asking them to explain what the Class B condition is/was so a CS can correctly deal with the RFE. Thanks for your advice, I appreciate it.
