Timeline

So I just found out I have to leave here (Canada) by the last day of April. Atleast I need to sign out of the base, I can take annual leave, but I don't really want to "waste" vacation time waiting around here for an interview. So we are thinking of just leaving here and going down to Utah to get settled into the house we just bought and then either just my hubby or both of us flying back to Montreal for the interview.

I am just not sure what we can use as proof of him coming back... we know he has to come back for the interview and don't want to do anything illegal.... it's just that we planned on driving to Utah and I don't want to make that trip on my own with 2 kids.

What do you guys think?

The hubbys last day of work is the 2nd of April so he wont have an "employer" to write a letter saying he needs to come back, but he will of course come back. I am still hopeful on getting an April interview, or May at the latest.

I hope someone has some encouraging advice.

7 Nov 2008- I130 approved in Toronto!!

21 Nov 2008- Received Packet 3 from Montreal

4 Jan 2009- Mailed Packet back

9 Feb 2009- Medical in Toronto

24 Apr 2009- Interview in Montreal...Approved!!!

30 Apr 2009- Received Visa... few hours later crossed to border for the 6 day drive to Utah!!

6 Apr 2009- Arrived at our new HOME!!

13 May 2009- Welcome letter received

19 May 2009- Went to social security office and "applied" for SSN

22 May 2009- SS Card arrived in mail!! (I guess they did send in the paperwork at the interview...)

Problem is, if he shows up at the border with all his worldly goods, and wife and kids in tow, and if he doesn't have his visa yet, he is likely to be denied entry and will have to take a bus back across the border. Even if he's got an interview letter in hand as proof that he'd be returning, they could still deny him entry.

It really is a ####### shoot. They're unlikely to just wave you thru under the circumstances.

I agree that you shouldn't try to cross with him.

Hmmm- can you go to Utah by yourself and have your husband stay here with the kids until the interview? If you don't want to go alone with the 2 kids (and I don't blame you) you don't have too many options. Your best bet may just be to use your vacation time. Sorry to hear you're having such a complicated go of things!

2004-09-03 : Met at college in USA and went on first date!

2008-01-02 : Married in Canada.

2008-01-07 : DH returns to USA.

2008-04-20 : Finally received marriage certificate from the province and filed 1-130 Petition.

2008-07-08 : I-130 Approved!

2008-09-15 : Received DS-230 and I-864.

2008-10-14: Mailed DS-230 and I-864

2008-10-30: DS-230 and I-864 received by NVC

2008-11-04: RFE

2008-11-18: Overnighted missing documents to NVC

2008-11-26: Case Complete at NVC!!

2008-03-02: Medical in Toronto

2009-03-23: Interview! Approved!

2009-04-04: The big move. POE: Blue Water Bridge. All went well.

2009-04-16: SSN arrives in the mail.

2009-04-24: PR card arrives in the mail.

That's a tough one Reeena. I'm pretty sure traveling with the kids to Utah is going to raise some red flags. (F)

Is there anyway you can stay on longer at the base? Work a couple extra weeks? Someone must have a heart over there?

Nope I can't stay here longer, and I only have 3 weeks vacation and we only earn 2.5 days a month, so it will take a whle to earn more time if I use it all.

I am thinking we are just going to risk driving, and just buy him a plane ticket back to show he is coming back that he is just helping us get settled. Atleast we are only 5 hours from the border so if they do say no to him we can just turn around and go back. We wont have all our stuff. The movers will send our stuff, we'll just have our luggage to get us by until our household goods arrive.

Keeping my fingers crossed we will get an interview in April and not even have to worry about this.

Also wouldnt this be no different than when somone goes to visit their spouse when they are wating for their interview date?

Seems to me, and I could be wrong - that proof that he has an interview would be enough.

As you mention, you aren't taking all your stuff, just your luggage. I don't know which border crossing you are going to use, however what I would do is call them and ask to speak to a supervisor and run it by them perhaps. While they won't give you any guarantees - i'm sure you will get a good idea how they will view it.

I agree.

The fact that you’re doing consular processing should be enough proof that he is returning to Canada. You are at the end of the DCF process and will not jeopardize it to adjust status. Bring proof of your DCF package and hopefully by the time you drive down to the US you will have the letter from Montreal with the interview date.

I agree with trailmix. I would make that phonecall which will perhaps save you some peace of mind. Remember to get his/her name so that you can bring it up at the border should they have questions. Let us know what you decide. Best of luck!
