Timeline

Once the K-1 visa expires, technically I'd have to leave the country. Is simply submitting the AOS really enough to stay legally?

Jun 2004 Met online at MBA4

Jul 2004 Fell in love

30 Nov 2004 Met in person in the US for the first time

03 Apr 2005 Three week vacation together in Chicago and Kansas City!

25 Jul 2005 James visits United States to propose. See Branson Balloon Website

27 Sep 2005 K-1 filed!

28 Sep 2005 K-1 petition received by government

04 Oct 2005 Got NOA1 in the mail

18 Oct 2005 Got NOA2 confirmation email! Less than a month!!!!

17 Nov 2005 Received packet 3

24-30 Nov 2005 James visits U.S. for Thanksgiving

08 Dec 2005 Received medical results. Everything ok!

19 Dec 2005 Sent packet 3

30 Dec 2005 - 4 Jan 2006 James visits U.S. for New Year!

17 Jan 2006 Sent packet 3 in AGAIN, after embassy said they had no record of the first one!

19 Jan 2006 Received packet 4 (interview date). No connection with mailing on 17 Jan! Interview set for 9:30 on Tue 7th Feb.

07 Feb 2006 APPROVED!!!

01 Apr 2006 James due to fly to America

09 Apr 2006 Wedding date!!

It's a misconception that the expiration date on the visa is the date you must leave the country. The expiration date is the last date on which you can use the visa to enter the country. It has nothing to do with when you would have to leave. The date on the I-94 (white card in your passport) is the date you have to leave by, unless of course you have a pending AOS.

As said above, the NOA-1 extends your status and allows you to stay past the date on the white card.

You get your very own kinda "limbo" status whilst you're waiting for AOS, I think the guy at our local office called it something like "pending adjustee", and advised me not to leave the country in the meantime as I had not filed for advanced parole.

Just sit tight, enjoy married life and dream of that greencard being processed! :P

01/10/05 - Arrived back in US

01/26/05 - Got Married! WooHoo!

02/14/05 - Had Medical Exam

02/22/05 - Filed for AOS in Seattle, in person

03/31/05 - Got EAD!!

04/02/05 - Biometrics and Fingerprinting

05/19/05 - AOS Interview - awaiting decision...

08/24/05 - (conditional) Permanent Resident

09/08/05 - Passport stamped in Seattle

09/19/05 - Recieved actual Greencard! YAY!!!

05/24/07 - 90 days to remove conditions starts!

06/02/07 - Filed I-751, California Service Center

08/09/07 - Biometrics and Fingerprinting

08/28/07 - I-751 Approved & conditions are removed!

09/12/07 - Recieved 10 year Greencard! YEAH!!!

*now contemplating N-400 and citizenship*

Yes I did word that incorrectly. By "visa" i meant the document which allowed me stay in the country :)

The DMV has their own 'rules' and whatever they deem is adequate is what you have to follow (even if it doesn't make sense) :)

Aug 22 - AOS interview date day 101-total days 342

Sept 29 - green card arrives, done until June 2008 day 140-total days 381

March 9 - Removal of Conditions approved! total days 1277
