I-751 RETURNED WITH THIS LETTER.

Gotta read the story about the person who thought the same and got denied at citizenship.

They never filed the I-751.

She did say she'd been married for less than a year when she received the card, no?

She said she was married 8 months at the time of the interview. Some wait many months after interview before the card is actually issued.

only 9 months when gc was received.

come on guys..do u think i have to file i-90.. theres no date on it or saying i have to ..it just states to correct classification. i thought maybe this was a generic letter or something with the top addressed in. also this letter come from the central director of vsc. so im thinking this letter is proof enough and his word is just as good as info pass. i need input.

me and my husband was planning a trip soon and i dont think im going to fool with the i-90 just yet if i dont have to.

There have been a number of us with the same situation as you. We also have this letter. You are good to go. I've done the calling, infopass, and I-751 and the result is always the same. Hold on to that letter. It is the best proof you can get. You do not need to do an I-90.

Exactly the same.

so i guess thats somewhat of a canned statement. they just fill in names. did yours have the i-90 stuff to.

If you think that having a 10 yr GC is an error, make an infopass. This is not your fault, it's USCIS mistakes. Why would you hire an expert lawyer to fix this and pay a $$$....

Ok, I am new and I know nothing, HOWEVER from the letter you attached it looks like they are admitting fault and telling you to get it fixed...

DO THE INFOPASS!

That is what the letter is telling you to do! :yes:

In the letter they said you have to request a replacement of your green card with the correct status because they made an error (and it is a option for that when you request your new GC), and I think your mistake was to wait until last minute to correct this, because now you will be late for your I-751.

The law is the law and that is the one you should listen to. remenber USCIS is a bunch of humans working there and they also make mistakes.

If it were me, I would call the 800@ and explain the situation to them. They may move you up to a supervisor. I have been moved up several times with questions. If you don't get a good answer, call again. I have had to talk to them two or three times to get them to understand and give me a good answer. They can sometimes help you without going for an INFOPASS.

If all that does not work, then get an INFOPASS.

You have a 10 yr GC and are not supposed to have.

Be ready with all the forms and evidence to file for your 10 year GC when they tell you to refile. You have everything back from them without processing. Correct?

I would not get an attorney. What can they do that you can't do? You have all the information.

I would not keep the 10 year GC and do nothing until you file for citizenship. I would not take a chance on messing things up at this point. You have too much time and money invested so far. I would not play games with USCIS. They are too big for me. It is an error on their part and you need to get them to fix it.

Good luck with your decision. You are getting a lot of advice on here. This situation affects you both and I strongly suggest you try and correct it.
