HI GUYS,

I wrote u a few weeks ago about my i-751. we was only married 8 months or so at time of aos interview. to my suprise we got a 10 year and not a 2yr. so just to be safe i send in the I-751.Today i recieved a letter stating this:

Examanation of your immigration records indicate that you were admitted or adjusted as a lawful permanent resident and not conditional. Therefore,this petition is not needed and action on your petition is hereby terminated. This termination is without prejudice to your permanent resident status.

if im reading this right it means i dont have to file and i keep orginal green card with 10 year exp. on it. is this correct/

You should have not submitted the I-751 in the first place since you did not have conditions on your residence.

Your next step -of you so choose- is to apply for citizenship.

i did it to be on safe side. in the uscis rules it states that anyone that wasnt married at least 2 years before aos interview was conditinal. i wanted to be safe. i didnt want this to bite me in the butt later on. now im sure and have evidence if something ever comes up

Correct!

Next up will be N-400 at three years of residency, if you wish to become a US citizen.

Their mistake is your bonus. I would hold on to that letter in case something comes up in the future.

Just curious, do you get your payment back?

Married 12-30-05

Started our visa journey Jan 06.

01-06 - I-130, K3 shortly after

04-06 - switched to Canada Immigration

07-06 - Moved to Canada (PR almost complete)

07-06 - Changed again, back to US imm.

09-06 - Landed as Canadian PR

10-06 - DCF Toronto, Approved in 1.5 hrs!

11-06 - Interview Montreal (success!)

I-130

10-05-06 DCF in Toronto - Approved

10-19-06 Packet 3 received & sent back

10-20-06 Montreal receives P3

11-03-06 Packet 4 received

11-06-06 Medical

11-22-06 Interview / Visa approved

Yeah, lucky draw there, nice for you, one less fee to pay.

I agree that you should keep that letter in case something comes up during citizenship if you choose to do so.

if you already have 10 years green card, why are you filing I-751 ? that's for 10 years card

I'm not sure that the advice given so far is sound, legally speaking. I would re-read that thread I referenced above and possibly contact an attorney. Personally, I wouldn't want to mess around with accusations of misrepresentation and the possibility of a negative impact on my naturalization.

hi guys i enclosed a sample of the letter. please read under it. it states something about sending in i-90 for correct classification . are they asking me to do this or should i keep what i the green cardi got.attachment=9787:lastscan.jpg]

Out of curiosity I went ahead and read the linked topic, and then read the topic that was linked in there last. From what I read both experiences have happened. One person had no issues with the citizenship process is now naturalized and another was denied citizenship due to not having filed the I-751, apparently they understood it was their mistake but it still was her case that was messed up and they couldn't approve it.

I'd contact an immigration lawyer and study up on this situation, so you have evidence showing people did get approved during citizenship and establishing that you did send the application as you should have if you had received the correct conditional GC and I'd also make an infopass appointment and get it in writing why you do not have the I-751 filed. Be on the safe side so you're less likely to run into problems down the road.
