Having sex and getting pregnant does not prove a genuine marriage. Your biggest worry should be the fact that you got married so soon after arrival that it looks like you had it all planned the fact that your wife is pregnant is not going to stop USCIS from looking at your case and seeing red flags.

I agree with you. I am wondering if he came here and she surprised him with the fact that she was pregnant and he decided to marry her right away would be a consideration?

I came to the US in 2005 on my B1/B2 visa which I was travelling on for 9 years and was rushed to the emergency room three days later because I became extremely sick. I was diagnosed with cancer the year before and was told by my doctor that I was going to die. I decided to get a second opinion and that was part of the reason I was here. Long and short of it, I met my husband about 3 wks while I was undergoing treatment and we seriously began dating a month after we met. I overstayed my time because I had to follow up on my doctor visits which was more important to me than losing my visa. As our relationship progressed we got married one year and eight months after our initial meeting; obviously by then not only had my I-94 expired but my visa as well. Eight months after marriage my husband who was also diagnosed with cancer was told that it had returned and it made him too ill to work. Our financial situation became harder as we focused on medical expensed and that was a setback to our filing. April will be our second anniversary and we filed our papers this January. Will I be considered as overstaying with intent to marry? I did not request an extention because at that time I didn't know that I could have requested one.

05/11/2009 - Applied to remove restrictions on my SS Card
05/18/2009 - Received unrestricted SS card

10/13/2009 - My darling husband of 2 yrs 5 months 3 weeks 3 days passed away :(

The burden of proof is on you, not the USCIS.

I hope you are prepared. or they might just slap you back. :yes:

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Regarding your situation, your overstay might be a problem for you.

There is no surprise. I knew her and our families knew each other. No ethnic Clashes, No social or cultural differences. I have been visiting the US frequently. Ofcourse we were gonna get married. But back home. Things didn't work out the way I wanted it and we simply decided to go ahead. I have already spoken to a lawyer. She just laughed and said I am not one of these to be worrying about it. So doesn't matter what most of these people say. They just give their opinion with no authority or expertize. Most just share their good/bad experiences.

Anyways, with this i conclude this topic, since there is nothing more I can learn from here.

Saspak, the best thing to do is to get information from a lawyer. If you are interested you can go online to justanswers.com and ask your question. An immigration lawyer will answer in 2 mins for $15. Then again you said you spoke to an immigation lawyer who told you not to worry. Well don't worry about it. All the best. My sitaution is okay. I am not worrying about it. Take care of yourself, your wife and your baby on the way and again all the best.

Good Luck with your case. If you were really not conserned about your case you would not have been looking for information about the possible outcomes.

It very much sounds like you have not heard what you want to hear so you are disregarding everything that has been said here. I hope it all works out for you because your wife and baby need you here no outside the US trying to get back in.

It wouldn't really matter much if I have to leave. So far all that has happened, I call it fate. Else, i was never the sort to stay away from my home country for long. I started visiting this Forum to seek the advice pertaining to method of documentation, and how the applicants dealt with various scenarios. Trust me, even here, you'll find 50 different answers to a question you post. I have access to several other websites that give me a different advice each time I put up a question to double check. Everybody is concerned. I wont deny I am not. But i'll soon find out on my own anyway. Whats done is done. The USCIS has far graver problems of their own too. Their own funding and paychecks are in jeapordy the way things are over here. Maybe another 4 months and I would want to leave myself. :))) Anyways, thank you all for your input.
