B1/B2 Tourist Visa AOS applicants.

Timeline

I just wanted to see if there are many tourist visa AOS applicants like myself out there. Would like to share my experience and timeline with them. Do write about yourselves if you care to reply to my post.

I arrived in the US on 11-09-2008. Got married on 11-14-2008. Applied for I-130 on 11-26-2008. Applied for AOS(EAD,AP,I-485) on 01-15-2009. Since then I have been waiting for the biometrics. So far I am able to drive on my international Drivers license but dont know if I can apply for for NY state license without EAD or GC. Which by the looks of it seems will take a long time, since i have not even had a biometrics appointment yet. Cant even schedule an infopass since its not been 60 days since i submitted my case. Its a looooooooooooong tiring process.

Yikes - that is a big red flag! Hope you have evidence of your intent...

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Its a looooooooooooong tiring process.

Yes, but not nearly as long as those who first wait for a fiance visa, THEN start the AOS process! Adjustment from visitor status is is only legal if you entered *without* intent to marry *and stay* - entering and then in 2 weeks filing does look a little suspicious, so make sure you can prove your intent!

10/9/10 - Package sent to Vermont

10/13/10 - NOA1 date, received 10/18

You are going to have to have some very strong evidence that proves you did not enter the US with the intent to remain and file for AOS.

You also should have filed your AOS along with your I-130 but thats another story. Your biggest problem is that you entered the US and 5 days later you got married. So when did you decide to get married was it before you entered or after you entered, did you know your spouse prior to entry or did you just meet him/her after you entered the US.

Do you have strong evidence of your intent to return to your home country? letters from employer stating that you were expected to return on a given date, landlord or mortgage papers showing your still had a home there, ownership of a car or other property that you would need to dispose of, Active bank accounts or credit cards from your home country. You could be in big trouble here if you dont.

You may want to have a meeting with a good immigration lawyer to go over your evidence and get advice about your options if you are denied your AOS on the grounds of misrepresentation and visa fraud.

I understand I have to have strong evidence to prove that I had no intention to stay. Here's my case. See how you would see it. I have been visiting the US since 1993. I had met my wife last year and visited her twice before. We did have an intent to marry, but I was going to file for I-130 and go back. That is the reason I didn't apply for AOS concurrently. I never had the appropriate documents to file since i never had the intetion to file for AOS this trip. Since I was managing my own private Equity Fund, after getting married, and finding out that my wife is expecting, I just decided to file from here. Everything I have is still back home. My bank accounts, my house, my investments. I never got the time to wind up anything since I never came here with the intention. So?????..... DO you still think I am in trouble?

As long as you can prove all what you state, you should have no problem....

but you should consult a lawyer asap to go over your case.

As long as you can prove all what you state, you should have no problem....

I am still using my Credit cards from back home. Still actively trading my stocks back home. All my assets are still left to be disposed off. The reason I didn't consult a lawyer was that I sincerely thought, I didnt need one as my intentions werent fraudulent. Dont know what to do beyond that. I did discuss my case with am immigration lawyer who happened to be a family friend and she said she saw no reason why I would have any problems.

Its ok man.... they way I see it.. its just be prepared to all questions they may ask you on your interview..

I dunno why the people that posted here are being ####### about it... theres kid's using the vwp or something else and they get away with it..

As you say.. you didnt have intention to stay.. so... its ok...

and the fact that ur wife is pregnant is another strong evidence for them not to deny you..

01-21-09......EAD touched again

01-26-09......EAD and AP received on the mail!!

01-27-09......Applied for SSN

02-03-09......SSN Received

02-24-09......Interview at 12:00 pm in San Diego !! APPROVED!!

02-28-09......Welcome Letter Received & approval for I-130!!

03-09-09.......Green card in the mail!

Thank you Carmen & Aldo,..... You are right. Fate has its own course to follow. As I was replying to this Topic on the Forum, I just received two Biometrics Apointments for I-485 & I-765. Scheduled for 03-13-2009. I pray for you all. Pray for me.

Actually, USCIS could if they think you committed visa fraud. If you really did come without the intention of marrying and staying, take the process seriously and realize the risk you are taking.

Since yesterday, My I-130 file has been touched twice. Though its been more than 97 days since I filed, I am wondering if its time for them to make a decision on my I-130 petition. I had filed the I-130 seperately and then later filed for AOS requesting USCIS to consider it concurrently to the I-130, which I am assuming they did since all my cases are online and have just received the Biometrics for I-485/I-765. I filed for I-130 with the basic documents required. I am not sure if they will send me a RFE. Among other developments, My wife's pregnancy since the filing should be enough to establish a genuine relationship. Anybody care to advise?
