Well it is the end of the long Memorial Day weekend, the kick off of Summer. Summer of what for us?

Joy, dreams come true, waiting , heartache, ? who knows. But tomorrow this site will be chattering of USCIS, NVC, interview dates and etc. Some will see success, a move up from USCIS to NVC, some will see move from NVC to waiting on interviews date, some will see visas approvals, and visa denials.

Its not exactly what we dreamed of as children, but it is our life right now. So right now, I will enjoy the Texas sunset on the front deck, and have a couple more margaritas, turn in , then awake tomorrow to deal with all the above. Yes folks this is our life. Enjoy! and cheers to my fellow margarita drinkers. Sure my huband would not approve of me and margaritas, but what the heck, not much of a life without him here.

Cheers!!

Truly happy!!!

New life, new adventures, and a new attitude.

If she has the baby before she has her VISA in hand, then they may make her take a DNA test to prove that it is indeed her husbands child. And as far as children go, as long as it's the child of an American Citizen, then just apply for the child's citizenship, and it should be fine. o_O but I could be wrong.

Most likley she needs to worry about is a visa delay, cause most likely USCIS will do DNA on her and kid to make sure it belongs to her husband U.S. Citizen. USCIS will not take just the word of the parents that Petitoner ( U.S. Citizen ) is the father to the child. Ive seen it befofre here on VJ.

She will I believe 99% have to file petition on the baby if born overseas . I wish her a healthly pregnancy.

She surely does not need this added stress to this process.

No Ber, you are `100% correct, same as I was writting when you did your post, DNA test to show the father Petioner U.S. Citizen is the father.

Truly happy!!!

Well, I've had several friends who have given birth in Canada and the father was a US Citizen. All they had to do was apply for the child's citizenship and all was well in the world. It may be different in the Philippines though.

Taken from http://www.visajourney.com/forums/index.php?showtopic=193134

Most likely, the child will be a US citizen from birth but this is NOT necessarily true - it depends upon the USC parent's US residency test.

In short - if the baby is born outside of the US to parents one of which is USC and the other is non-USC, then the baby is a USC from birth ONLY if the USC-parent resided in the US for 5 years of which at least 2 years were after age 14. The USC parent must be able to demonstrate that residency (school records, etc.)

If the USC parent does not meet that residence requirement, it is possible for the baby to derive US citizenship from birth via the grandparents (parents of USC parent) if either of them satisfies the residence requirement.

Failing that, the child is not a USC from birth. The child can be naturalized, or the child may be able to automatically acquire US citizenship through legal entry to the US under the Child Citizenship Act of 2000.

i think you can try contacting lostgurlsofia...(or was it lostgirlsofia)... they had a kid in Philippines who is waiting for a CR2 visa (Did i get this right?). The father was a US Citizen, i think, mother was a filipina.. the child was born after the visa was issued... or something like that.

took a breather away from VJ. Needed to regroup myself and find joy in simple things like watching TV series and cooking. Stressed out from all my 'visa' issues... this process got me so depressed. :( I didn't want to come here and spread my negativity around.

I feel much better now.

Like I said, it it depends upon the USC parent's US residency test.

So if the husband's parents do not meet the requirement, then they are not a USC by birth. But definately look into it.

Thanks March filers for your fast reply.Sorry I don't reply sooner.I was in Cebu City to have my 2nd shot of HPV vaccine then when I come home last night I don't have internet connection...I already told my friend that she just wait till she give birth so that her husband can file the petition both of them in the same time...
