Contact in last 2 years

Hi

Currently in USA we are considering getting married we have known each other for last 5 years however other than this trip we have not seen each other in last 2 years last saw each other 2.5 years ago, lots of phone calls etc we can prove.

Just worried if we marry now in next month will they say although we have known each other for 5 years been in a relationship 3 years that the fact we have not physically seen each other for 2.5 years we do not qualify under 2 year rule?

Or will this trip even if we marry on it count as contact in the last 2 years? Or must there be something prior to this trip in the last 2 years?

Hope that is not confusing question???

Hi fellow somerset person ;)

Your current trip counts. You would have had problems had you tried to file prior to this trip.

Make sure you document your visit. Start taking pictures now and keeping flight stubs etc these will count as your proof of having met in the last 2 years.

Of course if you get married and then file....the marriage certificate will pretty much indicate that you have been together recently as well.

10/02/2009 - EAD Approved (card production) & AP approved!

10/11/2009 - EAD Card received

10/20/2009 - AOS approved, GC card production ordered! (53 days in total)

10/26/2009 - Green Card received - nearly 11 months to the day of our K1 NOA 1!

11/25/2009 - Started my new job!

02/26/2010 - Passed my driving test :-p

07/20/2011 - Eligible to remove conditions

2012 - Going for citizenship

09/20/2011 - Removal of conditions submitted to VSC....here we go...again!

It's been a quick and relatively painless journey thanks to tireless research, dumb luck and this community :)

DONE with USCIS for a while :)

if you took prove of intent to return! and had no intention of marrying before you ente4red then you are allowed to marry and adjust status! although this is frowned upon it has been done beforre! its up to you weather you want to risk it or go through the proper proces sof k1 or k3 ( get married and return home)

If you get married now, you will file for a K-3, not K-1 and the K-3 does not have this requirement (obviously, you are already married)

If you file for a K-1 your current visit will meet the requirements for the petiton

If you get married, the two-year meeting requirment no longer applies because you won't be filing a petition for a fiance(e). You'll be filing for a spouse. Believe me, it can be a hard concept to get your head around. I filed out forms for my wife and I and wrote "none" where it asked for spouse name. :thumbs:

If you meet on "this trip" and don't get married, the visit "counts".

Facts are cheap...knowing how to use them is precious...
