I'm trying to figure out how this whole I-864 and I-864a thing.

Here is the situation, My husband and I are living with his uncle. But my husband is a full-time student, so he has no income. And uncle is willing to support us financially.

After reading all the instruction, here is my conclusion,

I'm the "principal immigrant", my hubby is the "sponsor" and his uncle is the "household member".

So my husband need to file Form I-864 and uncle need to file Form I-864a.

But here comes the questions,

1. Does uncle need to file an I-864? (For some reason it says I-864a can't be file alone.)

2. In part 5 question 21 of the I-864, it asks about Household size.

21a says "Persons you are sponsoring in this affidavit", I suppose its "1" because of ME.

But 21c says "If you are currently married, enter "1" for your spouse.". I think this will be "1" again because of ME!!

But it clearly says DO NOT COUNT ANYONE TWICE on the top of the page. Now I'm confused, I don't think its right to put "0" in 21c because we are married.

If anyone have any ideas what I'm talking about, I will be very appreciate your inputs.

Jan 13, 2008----Arrive in Atlanta POE

January 15, 2009--Apply for SSN Number

Jan. 23, 2009---Married

March 2 2008----Received SSN card

March 14, 2009---Got Driver's License

AOS TIMELINE

Mar. 30, 2009: AOS/EAD/AP filled

April 7, 2009 - EAD,AP and AOS NOA notice date

April 10, 2009 - received NOA1 hardcopy for EAD,AP and AOS

April 13, 2009- received Biometrics appt scheduled April 25, 2009

April 14, 2009-Biometrics walk-in done!

April 14, 2009-Called USCIS for AP to be expedited.

April 16, 2009-AP approved YES!!

April 24, 2009-EAD Card Received!!

So does anyone know if we need to file 2 I-864?? One for my husband and one for uncle??

Or is one I-864 for husband and one I-864a for uncle is good enough?

Sept 18 2009 - Moved to NC-WooHoo!
