I have a question about one-step filing. I am married to U.S citizen. We are planning to apply for green card, but currently we cannot file I-864 because we cannot meet the requirement. In order to apply for green card, do we have to wait until we meet the requirement for I -864 and use one step filing or can we start to apply forms that we can file one by one and wait to file I-864 until we meet the requirement?

Your husband may need to get a co-sponsor. A USC and currently residing in the USA who meets the requirements.

I-130 for Parents (Mom and Dad)

3.15.2014: Mailed I-130 Packet for Mom and Dad

3.21.2014: Received email notification with case # for both petitions; case forwarded to NBC for processing

3.21.2014: Check cashed

3.22.2014: Hard copy NOA1 received

4.08.2014: Both I-130 approved (notification received via email) - It only took three weeks!!!

4.11.2014: Received NOA2 approval notice in the mail.

5.01.2014: Called NVC to ask for status of paperwork. Advised they received both application on 4.28. Advised to call in 30 business days for an update.

6.02.2014: Email notification received from NVC that shows parents' NVC case number and instructions to pay AOS Fee and fill out DS 261.

6.03.2014: Paid AOS fee ($88 for both petitions)

N400:
4.26.2013: Mailed N400 Packet

5.21.2013: Biometrics

7.18.2013: Testing and Interview

9.25.2013: Oath Ceremony

My concern is if you are out of status. If you are then you have to be extremely careful not to get entangled in anything.

Tank you for the reply. Unfortunately we cannot find co-sponsor at this moment. so we are hoping we can start to apply forms that we meet the requirement and send I-864 later.

I don't think USCIS has a "lay away plan". I guess you could file everything but the I-864 and respond when you get a RFE. They give you a time limit to reply. 89 days???? Not sure.

thank you very much for your help. I guess I have to find co-sponsor. If I find co-sponsor, do they have to be U.S citizen? My uncle lives in US. he is not citizen. currently his status is H-1. can H-1 holder be s co-sponsor?
