The processing time information that USCIS publishes is useless. And they do everything to ensure that they are not held accountable to it. First of all you cannot file a service request unless your case is at least 30 days outside their official timeline. That gives them an extra month. On top of that they publish the processing times as of December in February. That gives them another 2 months. So they have a 3 month buffer after they have started processing say July applications before the July filers can start bugging them (within which time they are likely to process all the applications from July anyway).

RooDee, WELL SAID!! I totally agree and some of us have figured out how they play the game. How I would love to have a huge clapping smiley right about now!!! :lol: Let me laugh instead of crying at the tragedy of it all :whistle:

The timelines from VJ need to be taken with a pinch of salt as well because they can be quite optimistic. For instance VJ timelines say VSC is working on September K3 cases whereas a majority of July and August filers are still waiting for approval. The VJ timelines are likely based on a small sample set with no mechanism in place to correctly account for expedited cases, cases transferred from VSC to CSC and so on (at the very least the I-130 timelines need to be split into K3 and CR1 because CR1 tends to be faster for I-130 approvals).

All in all I have found that spending too much time obsessing about the timeline information leaves me all the more confused and frustrated. There are some K3 cases from September that have been approved. Does that mean that I will also be approved soon ? But then again there are July filers still waiting. Does that mean I may have to wait another 2-3 months ? I wish there was more of a rhyme or reason to this process but as I have found with USCIS in the past (having gone through the green card and citizenship process myself), the best thing to do is to not get too stressed out and to let things happen in due course. Of course this is something you realize when you look back on the process but as you are waiting for an approval each passing day seems like a torture - especially if people behind you in the queue are getting ahead of you every day.

But explain one thing to me guys. Am I miscalculating?? :wacko: How are we not out of date range when they posted 6 mons. as of DEC 31st and at that point on Feb 20th that is (when they posted the 6 mons timeframe) I was already at 7 months!! And that is the reason USCIS accepted my service request anyways??? Wouldn't that take them back to June and not APRIL?? Where the heck did they get the APRIL 1st from????? AGHHHHHHHH :girlwerewolf2xn: I refuse to give up and I will call them until I have an explanation! Or else let my senator deal with it! :no: I'm off to make that phone call and see what transpires out of it!

but I guess at the time we did our apps it was a good idea to do the k3 b/c the CR1 were taking way too long! this sucks totally...

In anycase, it makes me even more sad, upset, just don't know what to do...can I take back time??????????

yea but we still DID file the an I-130 which is required in order to file the K-3. I posted something about the LIFE ACT a few posts ago. Read that. It pissed me off. SO I wrote an e-mail to my attorney and I called the PA senators office. I totally blew right by the congressional office this time.

If it expired why have us file a K3? Not like we pay for the K3 anyway...it just makes more paperwork. No wonder they're backlogged. Not to mention - no wonder they put K3's on the backburner and take their time.

my attorney responded; he told me he hasn't heard anything about the K-3's being expired and he said it doesn't matter in my case because I already filed and they would grandfather me if all that is true. He seemed annoyed.... OH WELL... I paid him too.

Why do people catch such attitudes when you ask questions? JEEZE

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Sarita, I have to agree!! SUCKS FOR ALL OF US WHO THOUGHT K3 WOULD EXPEDITE THINGS!!!

Okay, so here is my story from the phone call I just placed: INDEED WE ARE OUTSIDE OF PROCESSING TIME FOR I 130, THAT WAS CONFIRMED TO ME BY USCIS JUST NOW. So why the heck is VSC claiming I am currently WITHIN the date range and that they are processing APRIL 1st? My theory: I guess they didn't count on us K3 suckers who were born ahead of the game :yes: or hoping we go mad outta of our minds and cancel our petitions and as a result they will have less files to process :rofl:

Anyways, I am not mad and I refuse to get mad. If I get mad, it means I am making myself sick and no one else is paying for the anger/sadness/depression but me and my husband. All we can do at this point is wait for things to run their course. Me getting mad is not gonna help bring about an approval any faster.

Jen, at least urs is with an abjudicator. Yeah it sucks you don't know what's going on as of yet, but at least it's sitting on someone's desk and not in a box somewhere!! Hope u get ur approval by the end of the week. It's tough once u crossed that 250 day mark. So I totally understand ur frustration! :luv:

So where is my file? I will leave it up to my senator to keep pushing especially since USCIS confirmed I was out of date range by 2 mons and 12 days!! I am getting on the phone to his office immediately! While I won't get mad, I won't sit in the corner and not do my part either. It would be so ironic if they moved it back to the "within processing times" instead of placing it with the "outside processing time" bin :unsure: since according to the email I got from VSC, I am WITHIN AND NOT OUTSIDE PT :wow: if that were to happen! Though the immigration officer I spoke to said no that wouldn't happen b/c they keep the files together based on the filing date. Let's hope she is right!

Joke # 2: I was told YES U R OUTSIDE OUR PROCESSING TIME, BUT THE PERSON SHOULD NOT HAVE PLACED AN EXPEDITE BASED ON THAT REASON CZ TECHNICALLY THAT IS NOT CONSIDERED AN ERROR. SO ONLY THING WE CAN DO IS WAIT FOR MARCH 22ND TO ROLL BY TO GET THE SERVICE REQUEST RESPONSE.

OK I got a response to the Expedite request.... The dumb broad who put in my request used MEDICAL as a reason so now they are requesting the same ####### they asked for before..... Are these people for real ?? Now I have to call and tell them she used the wrong reason... I think they just want you to be frustrated so you will back down and run away with your tail between your legs... then they can cancel your petition..... One less to process

I thank you so much for your response and support. This whole delayed process has gotten me & my hubby at each others throats with frustration. Thank God we've maintained our ability to take a step back, breathe & still laugh with each other but its really taking its toll.

Truthfully, I'm really torn as to what to do next - call, not call, wait for the max date to hear from VSC, submit for service request - our heads are really swimming ??????????

I'm really hoping with VSC giving us a April 2nd date for 60 days to reply our RFE that they rec'd back on Feb 2, 2009 that the VSC timelines are accurate cause heres what ours states:

Based on timeline data, your I130 may be adjudicated between November 15, 2008 and December 22, 2008*.

Based on timeline data, your I129f may be adjudicated between March 7, 2009 and March 30, 2009* (this includes an estimated 14 day delay for your RFE).

Hasn't been the best start to March for K3 at all. I had hoped with so many approvals coming out this past January that maybe VSC had imporved their procesing times but NO - very disappointing.

We have been waiting (as of today) for 259 days since filing our I130 & 199 days since filing our I129F. When we called VSC 2 weeks ago, we were told we can file a service request on April 2 if we dont hear anything from them by that date.

Yes, we got an RFE & yes we've seen a few couples come through & get approved on K1 even with an RFE who have a SHORTER timeline from than us.

Even with checking Igor's list, numerous couple who filed in June - like us - have been approved as well as couples on K3 after us from July, August & did I see a September approval? I know the process for each may be different but #######...? K3's design was to eliminate lengthy seperations. I dont even want to think about what the extra stress of waiting will do to us if we also have to endure a loooooong AP process to.

We have done our fair share of waiting like everyone else but are only becoming increasingly impatient and disappointed. Wish you all the best & sincerely hope we all get what we want very, very soon. (F)

Call and put in an EXPEDITE request ( not a service request) and use ERROR as your reason due to your file being out of the date range on the USCIS website. Your expedite might not get approved BUT maybe it will draw attention. Put in a request for both petitions.

May 11, 2010 - text message stating application received

May 13, 2010 - NOA1 for AOS

May 17, 2010 - Biometrics letter rec'd

June 10, 2010 - Biometrics appt

August 03, 2010 - AOS @10:45 am - "conditional" approval pending corrected medical form by Civil Surgeon

Sept 8, 2010 - AOS Approved for 10 year Greencard!!!
