Hasn't been the best start to March for K3 at all. I had hoped with so many approvals coming out this past January that maybe VSC had imporved their procesing times but NO - very disappointing.

We have been waiting (as of today) for 259 days since filing our I130 & 199 days since filing our I129F. When we called VSC 2 weeks ago, we were told we can file a service request on April 2 if we dont hear anything from them by that date.

Yes, we got an RFE & yes we've seen a few couples come through & get approved on K1 even with an RFE who have a SHORTER timeline from than us.

Even with checking Igor's list, numerous couple who filed in June - like us - have been approved as well as couples on K3 after us from July, August & did I see a September approval? I know the process for each may be different but #######...? K3's design was to eliminate lengthy seperations. I dont even want to think about what the extra stress of waiting will do to us if we also have to endure a loooooong AP process to.

We have done our fair share of waiting like everyone else but are only becoming increasingly impatient and disappointed. Wish you all the best & sincerely hope we all get what we want very, very soon. (F)

Call and put in an EXPEDITE request ( not a service request) and use ERROR as your reason due to your file being out of the date range on the USCIS website. Your expedite might not get approved BUT maybe it will draw attention. Put in a request for both petitions.

Just called. They told me I can't expedite just because I am out of the date range. The guy lied to me last week and told me he was putting in a service request for my K-3. He put one in for my CR-1. So they told me I need to wait 30 days from Feb 20th to call back. I did get my call transferred to an officer who told me the reason it is taking so long is the security check on both of us. ( not sure I believe him) but he did say that if I am with an adjuducating officer I should be hearing something really soon. He had a real heavy Jamaican accent and was really hard to understand. He told me not to worry as long as I ddn't get any RFE's or Notice of intent to deny.... THAT KIND OF THREW ME !!! But I'm not going to worry. UGHHHHHH

I did end up being able to put expedite requests in for both of my petitions yesterday. I used the error reason. Error because my petitions are out of the time frame given on the website. They told me I will hear something within 5 days. And I am sure they will be asking for evidence to back up my claim.. But I am really just hoping to get someone to look at my petitions !! Kind of a fire under someones BUTT type thing. I have the worst luck, so it probably won't work.

call again and ask for an expedite. they will take info from you. Listen to the list of reasons and then pick ERROR.

I hope something comes through today for all of us.

In my experience - USCIS will find any and every excuse to deny your expedite request :ranting:

I think they forgot how to do simple math. If the processing times as of Dec 31st say 6 months, that would mean that they should be processing files as of the last week of June/First week of July. If you extrapolate that out to March 3rd, then you are outside of the current processing times. Clearly simple math does not work in this case....hang in there!!

The times they post are just so they have a way out when folks call for expedited requests. People waiting for approvals really understand where they are interms of processing requests. A number of June folks have gotten approvals, so I would think the July NOA1 approvals should be on the horizon.

I'm totally confused here....

I went to Igors list and it shows that some people with the CR1 with NOA1 dates from Jan 2009 have gotten approvals, am I reading this correct?? is this possible? and what do I go by my K3 date or CR1 NOA1 date? either way nothing has been approved for me or others around my time, but for people beyond it seens no problem.mmmmm totally confused an dupset about this!

Ok, I am not getting e-mails when new there are new posts so that is why I haven't posted

OK, I haven't heard anything on my requests yet BUT the dates they gave you were from the BS line they were dishing out before they updated the website on the 25th. So I would call and talk to the rep and ask them what the CURRENT timeframe is. When they tell you MAY 15th ( or whatever BS story they are telling now) tell her about the response you received and tell her you KNOW this information is incorrect and you want someone to look into it today. Tell her someone made a mistake. Lie if you have to and tell her those aren't even the dates you were told over the phone when you made the request. Ask her if they have started UNProcessing the petitions because the dates are now going backwards.. Now I can't wait to see the BS they throw at me.

I seriously think VSC was closed yesterday due to weather. Even my husband heard about all the snow on the News in Costa Rica.

The processing time information that USCIS publishes is useless. And they do everything to ensure that they are not held accountable to it. First of all you cannot file a service request unless your case is at least 30 days outside their official timeline. That gives them an extra month. On top of that they publish the processing times as of December in February. That gives them another 2 months. So they have a 3 month buffer after they have started processing say July applications before the July filers can start bugging them (within which time they are likely to process all the applications from July anyway).

The timelines from VJ need to be taken with a pinch of salt as well because they can be quite optimistic. For instance VJ timelines say VSC is working on September K3 cases whereas a majority of July and August filers are still waiting for approval. The VJ timelines are likely based on a small sample set with no mechanism in place to correctly account for expedited cases, cases transferred from VSC to CSC and so on (at the very least the I-130 timelines need to be split into K3 and CR1 because CR1 tends to be faster for I-130 approvals).

All in all I have found that spending too much time obsessing about the timeline information leaves me all the more confused and frustrated. There are some K3 cases from September that have been approved. Does that mean that I will also be approved soon ? But then again there are July filers still waiting. Does that mean I may have to wait another 2-3 months ? I wish there was more of a rhyme or reason to this process but as I have found with USCIS in the past (having gone through the green card and citizenship process myself), the best thing to do is to not get too stressed out and to let things happen in due course. Of course this is something you realize when you look back on the process but as you are waiting for an approval each passing day seems like a torture - especially if people behind you in the queue are getting ahead of you every day.

I was able to put in a service request for the I-130 on the 20th of Feb and two expedite requests the other day.

They tell you they can't put them in but they really can. I have confrmation numbers. I was surprised when they offered to help. So whatever I guess. I know nothing will light a fire under the VSC. But at least I am doing something. My husband asked me not to say anything until the approval comes through.. I can't be like that. I need to be doing something.
