Hello everybody!

I have a question in regards to obtaining a tourist visa. So my question; is it possible to apply for a tourist visa while my wife and I are waiting for K3 visa to be approved? We got married last month, and this week we will start the filing process, but unfortunately it is so hard to wait that many months apart. Is there any solution? Or is the only solution is to be patient and wait...

You can apply for a tourist Visa, however the fact that you have a pending K-3 petition will work against you since you are planning for your spouse to immigrate to the US. Your spouse will have to prove that she has significant ties to return back to her country.

My wife has a current, valid five year tourist visa, but we are not even going to try. She did visit last summer with her father, but it was before we were married. With her K3 pending, there is little chance that they will let her in now. They ASSUME the pending immigrant will not return, even with a return ticket. You can apply, but it is unlikely that she would be allowed in at the point of entry, even if they gave her the visa.

That is not always true. As long as you can show strong ties, they will let you come in to visit as much as you wish. Umit just came over in January 2009, for two weeks, and they just asked her questions, looked at her return ticket info, and said "Have a good time - here is six months...."

She had a valid B1/B2 visa prior to our K-1 petition.

Of course, depending on the country your coming from, and how long you had the visitors visa, may play into it. But alot of people come and visit during the visa waiting period.

Sadly, Umit had very strong ties (work and apartment with a devil kitty cat) that prevented her from staying the full six months with me.... :crying:

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I disagree with the don't try it advice...

We filed our K1 in March 2009 and on April 15 2009 my SO applied and was granted a B1/B2 visa from the US Embassy in Warsaw. At first they did not want to approve her application, but ultimately they did. She was cautioned to NOT overstay any visit and that she could be denied entry at the POE (as any visa holder can).

I do agree that it is very very difficult to get a tourist visa while a K1 is processed but not impossible.

first thing you wont get it , 99%

second thing . suppose you got and travelled to usa you will have to go back to Algeria to complete you K-3 process

just be patient and wait

This is bad adv, unless you have hard evidence of the bolded, refrain from giving adv of this kind.
