Ok this is the deal: in 1 week time I'll leave to my country for about 2 months, my husband will leave with me but he will stay for only 2 weeks. So now I don't know what to do since my case is still pending. I have my 1 yr extension letter, I have my 2 yr green card that expired just a month ago & my valid passport to my country, so I kindly ask you the followings:

a) should I call the Immigration # 1 800 375 5283 in order to ask the status of my pending case & tell them I'll be away for 2 months, but then I don't know if calling them I might damage my pending case

B) should I send a letter to the immigration to let them know I'll be in my country for 2 months (as a good friend of mine suggested me)

c) should I do nothing, as my US husband says, since USCIS in California takes about 6 months for the ROC process & my docs were received about 4 & 1/2 months ago , so probably the immigration would say just "Wait as it's still too early....."

Can anybody suggest me any advice according to your personal experience or if it happened to you to be in the same situation, I mean pending case & going to your country for a while?

p.s.: I'm planning to leave copies of all docs already sent with some additional & new docs to my best friend here while I'll be away with my husband, just in case I might receive any RFE, and she'll check the mail for us.

Any suggestion is very very appreciated, tks to all of you!!!!! :star:

You will be be fine with your passport and your extension letter, to get back into the US. If your husband is going with you for only two weeks, when he returns to the US he can watch out for any RFE or possible interview dates in the mail. Now if an RFE arrives he is able to send the extra info, especially if you can gather up some info before you go. If you get an interview date there is probably enough time to either call and have the interview date changed or you get on the next available flight home.

Just came back from London yesterday.

It was my 4th trip overseas since my green card expired about 4 months ago.

No problem whatsoever at the POE at JFK. Only a slightly retarded airline employee at Heathrow needed to double and triple and quadruple check the extension letter with my passport stamps (where they write your A#).

I honestly think the conditional green card should be discontinued or at the very least, issued for 3 yrs not 2. While one can travel with the extension letter, not every airline employee or other country's immigration is familiar with this letter. I've seen quite a number of people experience delays when boarding flights headed for the US.

If the cards are good for 3 years, it will give the immigrant enough time to file for removal of conditions.

If it's good for 3 years, then we could directly file for naturalization and no need to remove conditions, then they will have one less excuse to extort money from us the honest tax payer, I will go out a limb here to bet they are NOT going to change it.
