Requesting W2 when I am self employed ??

Jocelyn had her interview today and she called me from outside the embassy to tell me they want my W2 forms. I am self employed and work with my father on the family far, I have no W2 forms to give them. I am thinking that perhaps they want me to go to a local IRS office and get Tax Transcripts and not the copies from my accountant. I should know more soon when she gets to the hotel and can use her cellphone. Does this sound right ?

yeah they can screw up and get 1099s confused with W2s.

Geton the phone bukas and havee IRS fax you tax transcripts just in case. You can scan or fax them to her.

Did she get a 221g requesting more evidence?

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I believe that is what she just said it was. She also had my 1099 for 2006 and 2007 but she didn't give it to them. She is going back now to give them but I doubt it works. My income on those years was below the poverty and even though I had my father for a co-sponsor they said they don't accept co-sponsors. When she returns I will have her scan the request for me so I can see exactly what I am dealing with. She said they asked how I made my income and I sent three check stubs from the grain elevators. I also sent a bank letter, real estate appraisal, life insurance cash options , etc. I am pretty depressed right now. I will see what she finds out in a bit and let you all know more so perhaps you can help. Thank you so much.

Did the copies from your accountant include all schedules and supporting documents or was it just the 1040? Transcripts are probably best but they may want to see 1099's or schedule C.

It was just the 1040's and I think there lies the problem. I think I should go to the office of the local IRS tomorrow and request the actual transcripts. Any advice is very much appreciated. Will I need to reschedule the interview or just have her walk in after I scan it and email it to her ?

She will have instructions for submitting the requested information.

If you are "self employed" you cannot get a w-2. You could get a 1099 from your father. Or tax transcripts showing your claim of self employement and payment of self employment tax

It appears that 3 things are checked on the form

1. US Federal Income Tax return for 2008

2. W2 Forms for years 2007 and 2008

3. Evidence of sustained Income

Ok so what can I do ? I sent her 1040 for 2006-2008 and I do not have a W2 or 1099 being a farm hand. How can I show evidence of a sustained income ? I can get tax transcripts of 2007 but I believe that it must be filed for 6 weeks to get 2008. The problem is 2007 is below the poverty line.

What I sent was 1040 for 2006-2008

Bank Letter showing $6,500 balance and $48,000 in deposits for 2008.

Appraisal of Real Estate for $33,500 ( No lien)

2 Life Insurance policies with a total of $28,000 and $3,000 cash value

Copy of my Deed

What should I try to do now in your opinion ?

You keep saying "1040". A 1040 is only part of a tax return. Anybody can fill one out with any figures they want to. It doesn't mean they filed it with the IRS or that they had the income. You're painting a picture for them that shows evidence you have enough income. To do so, you must have actual "evidence". When they ask for a W2, they are asking for "evidence" of income.

Ok, looking at my accountants paperwork I also have two other forms that may help.

I have Form 8879 "IRS e-file Signature Authorization" which has my Pin number and signature.

I also have a Form 9325 "Acknowledgment and General Information for taxpayers Who file Electronically which has a DCN number on it stating it was accepted on 2/18/09

Do those help ?

Do you have a schedule C showing profit and loss? The e signature just showed you file a tax return. It doesn't prove you filed the one attached to your affidavit. You're probably not going to be able to get anything from the IRS this soon. Call your accountant in the morning and tell him you need a "complete tax return including all schedules and supporting documents". Then explain you are trying to prove your actual income and ask him how he can help you do that.

Call IRS and have them fax you the last 3 years transcripts. 1-800-829 1040!

May not be able to get 2008 yet tho. Since USEM won't accept a co sponsor you'll have to meet the finacial requirements on your own with income and assets. Have your accountant help you meet the requirements anyway he can.

I will call my accountant as soon as they open to try to resolve this issue.

Why would the Air21 delivery service send her a tracking number when they are still wanting more info ? They had her fill out the info at the embassy and said she would just pay upon delivery. I assume its just a tracking number that will only be used once we are approved correct ?
